  1.1                          A bill for an act 
  1.2             relating to health care; requiring pharmacists to 
  1.3             disclose the cost of prescriptions; proposing coding 
  1.4             for new law in Minnesota Statutes, chapter 151. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [151.214] [PAYMENT DISCLOSURE.] 
  1.7      Subdivision 1.  [EXPLANATION OF PHARMACY BENEFITS.] A 
  1.8   pharmacist licensed under this chapter must provide to the 
  1.9   purchaser, for each prescription dispensed where part or all of 
  1.10  the cost of the prescription is being paid or reimbursed by a 
  1.11  group purchaser, the person's co-pay amount and the usual and 
  1.12  customary price of the prescription or the amount the pharmacy 
  1.13  will be reimbursed for the prescription drug by the person's 
  1.14  employer-sponsored plan or health plan company. 
  1.15     Subd. 2.  [NO PROHIBITION ON DISCLOSURE.] No contracting 
  1.16  agreement between a health plan company or its contracted 
  1.17  pharmacy benefit manager and a resident or nonresident pharmacy 
  1.18  registered under this chapter may prohibit the pharmacy from 
  1.19  disclosing to patients the total reimbursement to the pharmacy, 
  1.20  including the amount of the patient's co-payment and the amount 
  1.21  paid to the pharmacy by the health plan company or its 
  1.22  contracted pharmacy benefit manager.
