  1.1                          A bill for an act 
  1.2             relating to peace officers; providing increased 
  1.3             reimbursement for bullet-resistant vests; amending 
  1.4             Minnesota Statutes 2002, section 299A.38, subdivisions 
  1.5             2, 2a. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 299A.38, 
  1.8   subdivision 2, is amended to read: 
  1.9      Subd. 2.  [STATE AND LOCAL REIMBURSEMENT.] Peace officers 
  1.10  and heads of local law enforcement agencies who buy vests for 
  1.11  the use of peace officer employees may apply to the commissioner 
  1.12  for reimbursement of funds spent to buy vests.  On approving an 
  1.13  application for reimbursement, the commissioner shall pay the 
  1.14  applicant an amount equal to the lesser of one-half of the 
  1.15  vest's purchase price or $300 $600, as adjusted according to 
  1.16  subdivision 2a.  The political subdivision that employs the 
  1.17  peace officer shall pay at least the lesser of one-half of the 
  1.18  vest's purchase price or $300 $600, as adjusted according to 
  1.19  subdivision 2a.  The political subdivision may not deduct or pay 
  1.20  its share of the vest's cost from any clothing, maintenance, or 
  1.21  similar allowance otherwise provided to the peace officer by the 
  1.22  law enforcement agency. 
  1.23     [EFFECTIVE DATE.] This section is effective July 1, 2004. 
  1.24     Sec. 2.  Minnesota Statutes 2002, section 299A.38, 
  1.25  subdivision 2a, is amended to read: 
  2.1      Subd. 2a.  [ADJUSTMENT OF REIMBURSEMENT AMOUNT.] On October 
  2.2   1, 1997 2005, the commissioner of public safety shall adjust 
  2.3   the $300 $600 reimbursement amounts specified in subdivision 2, 
  2.4   and in each subsequent year, on October 1, the commissioner 
  2.5   shall adjust the reimbursement amount applicable immediately 
  2.6   preceding that October 1 date.  The adjusted rate must reflect 
  2.7   the annual percentage change in the Consumer Price Index for all 
  2.8   urban consumers, published by the federal Bureau of Labor 
  2.9   Statistics, occurring in the one-year period ending on the 
  2.10  preceding June 1. 
  2.11     [EFFECTIVE DATE.] This section is effective July 1, 2004.
