  1.1                          A bill for an act 
  1.2             relating to agriculture; recreation; providing for the 
  1.3             sale of nonoxygenated special recreational fuel; 
  1.4             amending Minnesota Statutes 1994, section 239.791, 
  1.5             subdivision 1, and by adding subdivisions. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 239.791, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [MINIMUM OXYGEN CONTENT REQUIRED.] Except 
  1.10  as provided in subdivision 1a, a person responsible for the 
  1.11  product shall comply with the following requirements: 
  1.12     (a) After October 1, 1993, gasoline sold or offered for 
  1.13  sale in a carbon monoxide control area, and during a carbon 
  1.14  monoxide control period, must contain at least 2.7 percent 
  1.15  oxygen by weight. 
  1.16     (b) After October 1, 1995, gasoline sold or offered for 
  1.17  sale at any time in a carbon monoxide control area must contain 
  1.18  at least 2.7 percent oxygen by weight. 
  1.19     (c) (b) After October 1, 1997, all gasoline sold or offered 
  1.20  for sale in Minnesota must contain at least 2.7 percent oxygen 
  1.21  by weight. 
  1.22     Sec. 2.  Minnesota Statutes 1994, section 239.791, is 
  1.23  amended by adding a subdivision to read: 
  1.24     Subd. 1a.  [SPECIAL RECREATIONAL FUEL.] To the extent not 
  1.25  prohibited by federal regulations, a retailer of gasoline may 
  2.1   sell and dispense gasoline not complying with subdivision 1 if 
  2.2   the following conditions are met: 
  2.3      (1) the gasoline is premium grade unleaded as defined in 
  2.4   section 239.751, subdivision 4; 
  2.5      (2) the gasoline is dispensed from a pump having a nozzle 
  2.6   spout with an outside diameter of not less than 0.930 inch; 
  2.7      (3) the gasoline is sold or offered for sale by a resort as 
  2.8   defined in section 157.15, subdivision 11, a marina, or a 
  2.9   dealer, as defined in section 296.01, subdivision 12; and 
  2.10     (4) the gasoline is sold to the retail customer for use in 
  2.11  an aircraft, a motorcycle, a snowmobile, a motor vehicle 
  2.12  manufactured before the 1976 model year or with an engine 
  2.13  manufactured before the 1976 model year, or for any other 
  2.14  highway use. 
  2.15     Sec. 3.  Minnesota Statutes 1994, section 239.791, is 
  2.16  amended by adding a subdivision to read: 
  2.17     Subd. 10.  [EXEMPTION; MOTOR SPORTS RACING.] This section 
  2.18  does not apply to gasoline with an octane rating of 100 or 
  2.19  greater sold or offered for sale at a public or private race 
  2.20  course solely for use during off-highway motor sports racing 
  2.21  events. 
  2.22     Sec. 4. [EFFECTIVE DATE.] 
  2.23     This act is effective the day following its final enactment.
