  1.1                          A bill for an act 
  1.2             relating to capital improvements; providing standards 
  1.3             for state assistance to capital improvement projects 
  1.4             of political subdivisions; proposing coding for new 
  1.5             law in Minnesota Statutes, chapter 16A. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [16A.86] [CAPITAL PROJECT GRANTS TO POLITICAL 
  1.8   SUBDIVISIONS.] 
  1.9      Subdivision 1.  [PROJECTS COVERED.] The capital improvement 
  1.10  projects covered by this section are only those not covered by 
  1.11  another state program of assistance to political subdivisions. 
  1.12     Subd. 2.  [BUDGET REQUEST.] A political subdivision that 
  1.13  requests an appropriation of state general obligation bond 
  1.14  proceeds for a local capital improvement project shall submit 
  1.15  the request to the commissioner of finance by June 1 of an 
  1.16  odd-numbered year.  The request must be submitted in the form 
  1.17  and with the supporting documentation required by the 
  1.18  commissioner of finance.  The supporting documentation must 
  1.19  include a predesign package that defines the purpose, scope, 
  1.20  cost, and schedule of the project.  All requests timely received 
  1.21  by the commissioner must be forwarded to the legislature, along 
  1.22  with agency requests, by the deadline established in section 
  1.23  16A.11, subdivision 1. 
  1.24     Subd. 3.  [EVALUATION.] The commissioner shall evaluate all 
  1.25  requests from political subdivisions for state assistance and 
  2.1   give higher priority to requests that meet the following 
  2.2   criteria: 
  2.3      (1) the political subdivision has provided for local, 
  2.4   private, and user financing for the project to the maximum 
  2.5   extent possible; 
  2.6      (2) the project is of strategic value to the state as a 
  2.7   whole; 
  2.8      (3) the project is of regional or statewide significance; 
  2.9      (4) the project will not require new or any additional 
  2.10  state operating subsidies; 
  2.11     (5) the project will not expand the state's role in a new 
  2.12  policy area; and 
  2.13     (6) state funding for the project will not create 
  2.14  inequities among local jurisdictions. 
  2.15     The commissioner's evaluation of each request must be 
  2.16  submitted to the legislature along with the governor's 
  2.17  recommendations under section 16A.11, subdivision 1, whether or 
  2.18  not the governor recommends that the request be funded.  
  2.19     Subd. 4.  [FUNDING.] If the commissioner recommends to the 
  2.20  governor that a project be funded, the amount of funding must be 
  2.21  no more than half the total cost of the project, including 
  2.22  predesign, design, construction, furnishings, and equipment.  
  2.23  The cost of predesign must be paid from nonstate sources. 
  2.24     Subd. 5.  [DESIGN.] Predesign and design of a political 
  2.25  subdivision capital improvement project for which state funding 
  2.26  is provided must comply with section 16B.335.
