  1.1                          A bill for an act 
  1.2             relating to local and state government; providing that 
  1.3             failure of a motion to approve a request is denial of 
  1.4             the request; amending Minnesota Statutes 2000, section 
  1.5             15.99, subdivision 2. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 15.99, 
  1.8   subdivision 2, is amended to read: 
  1.9      Subd. 2.  [DEADLINE FOR RESPONSE.] Except as otherwise 
  1.10  provided in this section and notwithstanding any other law to 
  1.11  the contrary, an agency must approve or deny within 60 days a 
  1.12  written request relating to zoning, septic systems, or expansion 
  1.13  of the metropolitan urban service area for a permit, license, or 
  1.14  other governmental approval of an action.  Failure of an agency 
  1.15  to deny a request within 60 days is approval of the request.  A 
  1.16  request is approved if the agency fails to act on it within 60 
  1.17  days.  A request is denied if within 60 days a resolution or 
  1.18  other properly made motion to approve the request fails or if 
  1.19  within 60 days a resolution or other properly made motion to 
  1.20  deny the request is passed.  If an agency denies the request, it 
  1.21  must state in writing the reasons for the denial at the time 
  1.22  that it denies the request.
