  1.1                          A bill for an act 
  1.2             relating to health; limiting the use of allergenic 
  1.3             latex in health care facilities; proposing coding for 
  1.4             new law in Minnesota Statutes, chapter 144. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [144.1215] [USE OF LATEX LIMITED.] 
  1.7      (a) No health care facility shall use powdered latex 
  1.8   products.  A health care facility may use other latex products 
  1.9   only in accordance with a written policy established by the 
  1.10  health care facility to prevent or reduce allergic reactions to 
  1.11  latex products through the use of low-protein latex products 
  1.12  where feasible. 
  1.13     (b) For purposes of this section, a health care facility 
  1.14  means a hospital, outpatient surgical center, or nursing home. 
  1.15     (c) The commissioner of health shall enforce this section 
  1.16  under the authority and procedures otherwise available to the 
  1.17  commissioner. 
  1.18     Sec. 2.  [EFFECTIVE DATE.] 
  1.19     Section 1 is effective January 1, 1999.
