  1.1                          A bill for an act 
  1.2             relating to human services; transferring funding for 
  1.3             certain ICF/MR's; amending Laws 1995, chapter 207, 
  1.4             article 3, section 21. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Laws 1995, chapter 207, article 3, section 21, 
  1.7   is amended to read: 
  1.8      Sec. 21.  [FACILITY CERTIFICATION.] 
  1.9      Notwithstanding Minnesota Statutes, section 252.291, 
  1.10  subdivisions 1 and 2, the commissioner of health shall inspect 
  1.11  to certify a large community-based facility currently licensed 
  1.12  under Minnesota Rules, parts 9525.0215 to 9525.0355, for more 
  1.13  than 16 beds and located in Northfield.  The facility may be 
  1.14  certified for up to 44 beds.  The commissioner of health must 
  1.15  inspect to certify the facility as soon as possible after the 
  1.16  effective date of this section.  The commissioner of human 
  1.17  services shall work with the facility and affected counties to 
  1.18  relocate any current residents of the facility who do not meet 
  1.19  the admission criteria for an ICF/MR.  Until January 1, 1999, in 
  1.20  order to fund the ICF/MR services and relocations of current 
  1.21  residents authorized, the commissioner of human services may 
  1.22  transfer on a quarterly basis to the medical assistance account 
  1.23  from each affected county's community social service allocation, 
  1.24  an amount equal to the state share of medical assistance 
  1.25  reimbursement for the residential and day habilitation services 
  2.1   funded by medical assistance and provided to clients for whom 
  2.2   the county is financially responsible.  After January 1, 1999, 
  2.3   the commissioner of human services shall fund the ICF/MR 
  2.4   services under the state medical assistance program and the 
  2.5   commissioner shall be responsible for the state share of medical 
  2.6   assistance reimbursement.  For nonresidents of Minnesota seeking 
  2.7   admission to the facility, Rice county shall be notified in 
  2.8   order to assure that appropriate funding is guaranteed from 
  2.9   their state or country of residence.
