  1.1                          A bill for an act 
  1.2             relating to health insurance; requiring coverage for 
  1.3             the diagnosis and treatment of infertility; proposing 
  1.4             coding for new law in Minnesota Statutes, chapter 62A. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [62A.0412] [COVERAGE FOR THE DIAGNOSIS AND 
  1.7   TREATMENT OF INFERTILITY.] 
  1.8      Subdivision 1.  [REQUIRED COVERAGE.] A health plan, as 
  1.9   defined in section 62A.011, including a health plan providing 
  1.10  the coverage described in section 62A.011, subdivision 3, clause 
  1.11  (3), that provides coverage for maternity benefits must provide 
  1.12  coverage for medically necessary expenses of diagnosis and 
  1.13  treatment of infertility.  For purposes of this section, 
  1.14  "infertility" means the condition of a presumably healthy 
  1.15  individual who is unable to conceive or produce conception 
  1.16  during a period of one year. 
  1.17     Subd. 2.  [SPECIAL RESTRICTIONS.] A health plan may not 
  1.18  impose a special deductible, copayment, or waiting period or 
  1.19  other special restrictions on coverage for the diagnosis and 
  1.20  treatment of infertility that the health plan does not apply to 
  1.21  maternity benefits. 
  1.22     Sec. 2.  [EFFECTIVE DATE; APPLICATION.] 
  1.23     Section 1 is effective August 1, 1997, and applies to plans 
  1.24  issued, renewed, or continued to provide coverage to a Minnesota 
  1.25  resident on or after that date.
