  1.1                          A bill for an act 
  1.2             relating to retirement; teachers retirement 
  1.3             association; authorizing certain former teachers to 
  1.4             purchase service credit for periods of employment by 
  1.5             the Lydia special education co-op. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [TEACHERS RETIREMENT ASSOCIATION; SERVICE 
  1.8   CREDIT PURCHASE OF LYDIA SPECIAL EDUCATION CO-OP EMPLOYMENT.] 
  1.9      (a) A person described in paragraph (b) is entitled to 
  1.10  purchase 20 months of allowable and formula service credit from 
  1.11  the teachers retirement association by supplying the 
  1.12  documentation required by paragraph (c) and by paying the amount 
  1.13  specified in paragraph (d). 
  1.14     (b) An eligible person is a person who: 
  1.15     (1) was a member of the teachers retirement association 
  1.16  from 1961 to 1969 for service as a secondary school teacher and 
  1.17  counselor; 
  1.18     (2) was a graduate student from 1969 to 1971 and was 
  1.19  awarded a doctorate in psychology; and 
  1.20     (3) was employed by the Lydia special education co-op to 
  1.21  provide school psychological services from August 1, 1971, to 
  1.22  May 1, 1973. 
  1.23     (c) The eligible person must provide adequate documentation 
  1.24  of the following: 
  1.25     (1) an employment period with the Lydia special education 
  2.1   co-op of August 1, 1971 to May 1, 1973; 
  2.2      (2) sponsorship of the Lydia special education co-op by the 
  2.3   Carver-Scott county mental health center; 
  2.4      (3) provision of school psychological services to the New 
  2.5   Prague school district, the Montgomery school district, the 
  2.6   Shakopee school district, the Prior Lake school district, the 
  2.7   Jordan school district, and the Belle Plaine school district; 
  2.8   and 
  2.9      (4) the composition of the co-op's governing board as the 
  2.10  superintendents of the member school districts enumerated in 
  2.11  clause (3). 
  2.12     (d) The purchase payment amount must be determined under 
  2.13  Minnesota Statutes, section 356.55. 
  2.14     (e) Notwithstanding paragraph (a), the Lydia special 
  2.15  education co-op or its successor, the Carver-Scott county mental 
  2.16  health center or its successor, the New Prague school district, 
  2.17  the Montgomery school district, the Shakopee school district, 
  2.18  the Prior Lake school district, the Jordan school district, the 
  2.19  Belle Plaine school district, or any combination may pay a 
  2.20  portion of the total service credit purchase payment amount.  If 
  2.21  a portion of the purchase payment amount is paid under this 
  2.22  paragraph, the eligible person must pay the balance of the 
  2.23  amount under paragraph (d). 
  2.24     (f) Any eventual retirement annuity from the teachers 
  2.25  retirement association must be governed under the teachers 
  2.26  retirement association law in effect on the day that active 
  2.27  service as a teachers retirement association member terminated 
  2.28  or the day that employment by the Lydia special education co-op 
  2.29  terminated, whichever is later. 
  2.30     Sec. 2.  [EFFECTIVE DATE.] 
  2.31     Section 1 is effective on the day following final enactment.
