  1.1                          A bill for an act 
  1.2             relating to education; providing for aid to charter 
  1.3             schools for growth costs; amending charter school 
  1.4             compensation pupil units; appropriating money; 
  1.5             amending Minnesota Statutes 1998, sections 124D.11, by 
  1.6             adding a subdivision; 126C.05, subdivision 3, and by 
  1.7             adding a subdivision; and 126C.10, subdivision 3. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1998, section 124D.11, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 9.  [GROWTH COSTS.] After the charter school's first 
  1.12  two years of operation, the charter school is eligible for aid 
  1.13  to pay for costs associated with growth by adding a new site or 
  1.14  for adding a new grade level.  The charter school's growth costs 
  1.15  aid is equal to $500 times the difference between the charter 
  1.16  school's pupil units served in the current year minus the pupil 
  1.17  units served in the previous year. 
  1.18     Sec. 2.  Minnesota Statutes 1998, section 126C.05, 
  1.19  subdivision 3, is amended to read: 
  1.20     Subd. 3.  [COMPENSATION REVENUE PUPIL UNITS.] Compensation 
  1.21  revenue pupil units for fiscal year 1998 and thereafter must be 
  1.22  computed according to this subdivision.  Charter school 
  1.23  compensation revenue pupil units for fiscal year 2000 and 
  1.24  thereafter must be computed according to subdivision 3a.  
  1.25     (a) The compensation revenue concentration percentage for 
  1.26  each building in a district equals the product of 100 times the 
  2.1   ratio of:  
  2.2      (1) the sum of the number of pupils enrolled in the 
  2.3   building eligible to receive free lunch plus one-half of the 
  2.4   pupils eligible to receive reduced priced lunch on October 1 of 
  2.5   the previous fiscal year; to 
  2.6      (2) the number of pupils enrolled in the building on 
  2.7   October 1 of the previous fiscal year. 
  2.8      (b) The compensation revenue pupil weighting factor for a 
  2.9   building equals the lesser of one or the quotient obtained by 
  2.10  dividing the building's compensation revenue concentration 
  2.11  percentage by 80.0.  
  2.12     (c) The compensation revenue pupil units for a building 
  2.13  equals the product of:  
  2.14     (1) the sum of the number of pupils enrolled in the 
  2.15  building eligible to receive free lunch and one-half of the 
  2.16  pupils eligible to receive reduced priced lunch on October 1 of 
  2.17  the previous fiscal year; times 
  2.18     (2) the compensation revenue pupil weighting factor for the 
  2.19  building; times 
  2.20     (3) .60. 
  2.21     The percentages in this subdivision must be based on the 
  2.22  count of individual pupils and not on a building average or 
  2.23  minimum. 
  2.24     Sec. 3.  Minnesota Statutes 1998, section 126C.05, is 
  2.25  amended by adding a subdivision to read: 
  2.26     Subd. 3a.  [CHARTER SCHOOL COMPENSATION REVENUE PUPIL 
  2.27  UNITS.] Charter school compensation revenue pupil units for 
  2.28  fiscal year 2000 and thereafter must be computed according to 
  2.29  this subdivision. 
  2.30     (a) The compensation revenue concentration percentage for 
  2.31  each building in a district equals the product of 100 times the 
  2.32  ratio of: 
  2.33     (1) the sum of the number of pupils enrolled in the 
  2.34  building eligible to receive free lunch plus one-half of the 
  2.35  pupils eligible to receive reduced priced lunch on October 1 of 
  2.36  the current fiscal year, to 
  3.1      (2) the number of pupils enrolled in the building on 
  3.2   October 1 of the current fiscal year. 
  3.3      (b) The compensation revenue pupil weighting factor for a 
  3.4   building equals the lesser of one or the quotient obtained by 
  3.5   dividing the building's compensation revenue concentration 
  3.6   percentage by 80. 
  3.7      (c) The compensation revenue pupil units for a building 
  3.8   equals the product of: 
  3.9      (1) the sum of the number of pupils enrolled in the 
  3.10  building eligible to receive free lunch and one-half of the 
  3.11  pupils eligible to receive reduced priced lunch on October 1 of 
  3.12  the current fiscal year, times 
  3.13     (2) the compensation revenue pupil weighting factor for the 
  3.14  building, times 
  3.15     (3) .60. 
  3.16     The percentages in this subdivision must be based on the 
  3.17  count of individual pupils and not on a building average or 
  3.18  minimum. 
  3.19     Sec. 4.  Minnesota Statutes 1998, section 126C.10, 
  3.20  subdivision 3, is amended to read: 
  3.21     Subd. 3.  [COMPENSATORY EDUCATION REVENUE.] The 
  3.22  compensatory education revenue for each building in the district 
  3.23  equals the formula allowance times the compensation revenue 
  3.24  pupil units computed according to section 126C.05, subdivision 3 
  3.25  or 3a.  Revenue shall be paid to the district and must be 
  3.26  allocated according to section 126C.15, subdivision 2. 
  3.27     Sec. 5.  [APPROPRIATIONS.] 
  3.28     Subdivision 1.  [DEPARTMENT OF CHILDREN, FAMILIES, AND 
  3.29  LEARNING.] The following sums are appropriated from the general 
  3.30  fund to the department of children, families, and learning in 
  3.31  the fiscal years indicated. 
  3.32     Subd. 2.  [CHARTER SCHOOL GROWTH COSTS.] For charter school 
  3.33  growth costs according to Minnesota Statutes, section 124D.11, 
  3.34  subdivision 9:
