  1.1                          A bill for an act 
  1.2             relating to human services; extending certain advisory 
  1.3             committees; exempting certain advisory councils and 
  1.4             committees from expiration; amending Minnesota 
  1.5             Statutes 1996, sections 15.059, by adding a 
  1.6             subdivision; 145.881, subdivision 1; 145A.10, 
  1.7             subdivision 10; 245.697, subdivision 1; 254A.035, 
  1.8             subdivision 2; and 254A.04. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1996, section 15.059, is 
  1.11  amended by adding a subdivision to read: 
  1.12     Subd. 7.  [EXCEPTIONS TO EXPIRATION DATE.] Notwithstanding 
  1.13  subdivision 5, the following committees shall continue to exist 
  1.14  and do not expire June 30, 1997: 
  1.15     (1) the medical assistance drug formulary committee 
  1.16  established under section 256B.0625, subdivision 13, paragraph 
  1.17  (a); 
  1.18     (2) the home care advisory committee established under 
  1.19  section 256B.071, subdivision 5; 
  1.20     (3) the traumatic brain injury advisory committee 
  1.21  established under section 256B.093, subdivision 1, clause (4); 
  1.22     (4) the preadmission screening, alternative care, and home 
  1.23  community-based services advisory committee established under 
  1.24  section 256B.0911, subdivision 8; 
  1.25     (5) the American Indian child welfare advisory council 
  1.26  established under section 257.3579; 
  1.27     (6) the maternal and child health advisory task force 
  2.1   established under section 145.881; 
  2.2      (7) the state community health advisory committee 
  2.3   established under section 145A.10, subdivision 10; and 
  2.4      (8) the Minnesota commission serving deaf and 
  2.5   hard-of-hearing people established under section 256C.28, 
  2.6   subdivisions 1 to 6. 
  2.7      Sec. 2.  Minnesota Statutes 1996, section 145.881, 
  2.8   subdivision 1, is amended to read: 
  2.9      Subdivision 1.  [COMPOSITION OF TASK FORCE.] The 
  2.10  commissioner shall establish and appoint a maternal and child 
  2.11  health advisory task force consisting of 15 members who will 
  2.12  provide equal representation from: 
  2.13     (1) professionals with expertise in maternal and child 
  2.14  health services; 
  2.15     (2) representatives of community health boards as defined 
  2.16  in section 145A.02, subdivision 5; and 
  2.17     (3) consumer representatives interested in the health of 
  2.18  mothers and children. 
  2.19     No members shall be employees of the state department of 
  2.20  health.  Task force members shall be appointed and removed as 
  2.21  provided in section 15.059, subdivisions 2 and 4.  The maternal 
  2.22  and child health advisory task force shall terminate on the date 
  2.23  provided by section 15.059, subdivision 5, and members shall 
  2.24  receive compensation as provided in Section 15.059, subdivision 
  2.25  6 governs the maternal and child health advisory task force. 
  2.26     Sec. 3.  Minnesota Statutes 1996, section 145A.10, 
  2.27  subdivision 10, is amended to read: 
  2.28     Subd. 10.  [STATE AND LOCAL ADVISORY COMMITTEES.] (a) A 
  2.29  state community health advisory committee is established to 
  2.30  advise, consult with, and make recommendations to the 
  2.31  commissioner on the development, maintenance, funding, and 
  2.32  evaluation of community health services.  Section 15.059, 
  2.33  subdivision 5 7, applies to this committee.  Each community 
  2.34  health board may appoint a member to serve on the committee. The 
  2.35  committee must meet at least quarterly, and special meetings may 
  2.36  be called by the committee chair or a majority of the members.  
  3.1   Members or their alternates may receive a per diem and must be 
  3.2   reimbursed for travel and other necessary expenses while engaged 
  3.3   in their official duties. 
  3.4      (b) The city councils or county boards that have 
  3.5   established or are members of a community health board must 
  3.6   appoint a community health advisory committee to advise, consult 
  3.7   with, and make recommendations to the community health board on 
  3.8   matters relating to the development, maintenance, funding, and 
  3.9   evaluation of community health services.  The committee must 
  3.10  consist of at least five members and must be generally 
  3.11  representative of the population and health care providers of 
  3.12  the community health service area.  The committee must meet at 
  3.13  least three times a year and at the call of the chair or a 
  3.14  majority of the members.  Members may receive a per diem and 
  3.15  reimbursement for travel and other necessary expenses while 
  3.16  engaged in their official duties. 
  3.17     (c) State and local advisory committees must adopt bylaws 
  3.18  or operating procedures that specify the length of terms of 
  3.19  membership, procedures for assuring that no more than half of 
  3.20  these terms expire during the same year, and other matters 
  3.21  relating to the conduct of committee business.  Bylaws or 
  3.22  operating procedures may allow one alternate to be appointed for 
  3.23  each member of a state or local advisory committee.  Alternates 
  3.24  may be given full or partial powers and duties of members. 
  3.25     Sec. 4.  Minnesota Statutes 1996, section 245.697, 
  3.26  subdivision 1, is amended to read: 
  3.27     Subdivision 1.  [CREATION.] A state advisory council on 
  3.28  mental health is created.  The council must have 30 members 
  3.29  appointed by the governor in accordance with federal 
  3.30  requirements.  The council must be composed of:  
  3.31     (1) the assistant commissioner of mental health for the 
  3.32  department of human services; 
  3.33     (2) a representative of the department of human services 
  3.34  responsible for the medical assistance program; 
  3.35     (3) one member of each of the four core mental health 
  3.36  professional disciplines (psychiatry, psychology, social work, 
  4.1   nursing); 
  4.2      (4) one representative from each of the following advocacy 
  4.3   groups:  mental health association of Minnesota, Minnesota 
  4.4   alliance for the mentally ill, and Minnesota mental health law 
  4.5   project; 
  4.6      (5) providers of mental health services; 
  4.7      (6) consumers of mental health services; 
  4.8      (7) family members of persons with mental illnesses; 
  4.9      (8) legislators; 
  4.10     (9) social service agency directors; 
  4.11     (10) county commissioners; and 
  4.12     (11) other members reflecting a broad range of community 
  4.13  interests, as the United States Secretary of Health and Human 
  4.14  Services may prescribe by regulation or as may be selected by 
  4.15  the governor. 
  4.16     The council shall select a chair.  Terms, compensation, and 
  4.17  removal of members and filling of vacancies are governed by 
  4.18  section 15.059.  The council does not expire as provided in 
  4.19  section 15.059.  Notwithstanding provisions of section 15.059, 
  4.20  the council and its subcommittee on children's mental health do 
  4.21  not expire.  The commissioner of human services shall provide 
  4.22  staff support and supplies to the council. 
  4.23     Sec. 5.  Minnesota Statutes 1996, section 254A.035, 
  4.24  subdivision 2, is amended to read: 
  4.25     Subd. 2.  [MEMBERSHIP TERMS, COMPENSATION, REMOVAL AND 
  4.26  EXPIRATION.] The membership of this council shall be composed of 
  4.27  17 persons who are American Indians and who are appointed by the 
  4.28  commissioner.  The commissioner shall appoint one representative 
  4.29  from each of the following groups:  Red Lake Band of Chippewa 
  4.30  Indians; Fond du Lac Band, Minnesota Chippewa Tribe; Grand 
  4.31  Portage Band, Minnesota Chippewa Tribe; Leech Lake Band, 
  4.32  Minnesota Chippewa Tribe; Mille Lacs Band, Minnesota Chippewa 
  4.33  Tribe; Bois Forte Band, Minnesota Chippewa Tribe; White Earth 
  4.34  Band, Minnesota Chippewa Tribe; Lower Sioux Indian Reservation; 
  4.35  Prairie Island Sioux Indian Reservation; Shakopee Mdewakanton 
  4.36  Sioux Indian Reservation; Upper Sioux Indian Reservation; 
  5.1   International Falls Northern Range; Duluth Urban Indian 
  5.2   Community; and two representatives from the Minneapolis Urban 
  5.3   Indian Community and two from the St. Paul Urban Indian 
  5.4   Community.  The terms, compensation, and removal of American 
  5.5   Indian advisory council members shall be as provided in section 
  5.6   15.059.  The council expires June 30, 1997 2001.  
  5.7      Sec. 6.  Minnesota Statutes 1996, section 254A.04, is 
  5.8   amended to read: 
  5.9      254A.04 [CITIZENS ADVISORY COUNCIL.] 
  5.10     There is hereby created an alcohol and other drug abuse 
  5.11  advisory council to advise the department of human services 
  5.12  concerning the problems of alcohol and other drug dependency and 
  5.13  abuse, composed of ten members.  Five members shall be 
  5.14  individuals whose interests or training are in the field of 
  5.15  alcohol dependency and abuse; and five members whose interests 
  5.16  or training are in the field of dependency and abuse of drugs 
  5.17  other than alcohol.  The terms, compensation and removal of 
  5.18  members shall be as provided in section 15.059.  The council 
  5.19  expires June 30, 1997 2001.  The commissioner of human services 
  5.20  shall appoint members whose terms end in even-numbered years.  
  5.21  The commissioner of health shall appoint members whose terms end 
  5.22  in odd-numbered years.
