  1.1                          A bill for an act 
  1.2             relating to elections; providing for periodic uniform 
  1.3             election days for state and local elections, other 
  1.4             than special elections to fill a vacancy; proposing 
  1.5             coding for new law in Minnesota Statutes, chapter 204D.
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [204D.035] [PERIODIC UNIFORM ELECTION DAY.] 
  1.8      Subdivision 1.  [SHORT TITLE.] This section may be referred 
  1.9   to as the "Periodic Uniform Election Day Act of 2004." 
  1.10     Subd. 2.  [ELECTIONS COVERED.] This section applies to all 
  1.11  state, county, municipal, and school district elections held in 
  1.12  the state of Minnesota, including elections conducted by mail 
  1.13  and elections on ballot questions, except for elections held to 
  1.14  fill a vacancy in office and required by statute to be held 
  1.15  sooner than the next day designated in subdivision 3.  
  1.16     Subd. 3.  [ELECTIONS ON DESIGNATED DAYS.] Notwithstanding 
  1.17  other law to the contrary, elections covered in subdivision 2 
  1.18  may be held only on the following days: 
  1.19     (1) the second Tuesday in March; 
  1.20     (2) the second Tuesday in June; 
  1.21     (3) the first Tuesday after the second Monday in September; 
  1.22  and 
  1.23     (4) the first Tuesday after the first Monday in November. 
  1.24     Subd. 4.  [PRIMARY ELECTIONS.] If other law requires that a 
  1.25  primary election take place for a particular election, the 
  2.1   primary may be held on one of the days designated in subdivision 
  2.2   3, except that elections mandated by statute to occur on one of 
  2.3   these four days must occur as statutorily scheduled.  The 
  2.4   general election for the same office must be held on the next 
  2.5   occurring of the four days listed in subdivision 3. 
  2.6      Subd. 5.  [UNIFORM ELECTION TIMES AND POLLING PLACES.] An 
  2.7   election held in a jurisdiction on one of the days specified in 
  2.8   subdivision 3 must be held at the same polling places and during 
  2.9   the same hours as the state general election, except that 
  2.10  polling places may be changed if a municipality has consolidated 
  2.11  precincts or redrawn a precinct to place the former polling 
  2.12  place in another precinct. 
  2.13     Subd. 6.  [APPLICABLE LAWS.] Except with respect to the 
  2.14  dates, polling places, and hours of elections, Minnesota 
  2.15  election law remains applicable to elections held on any of the 
  2.16  days listed in subdivision 3. 
  2.17     Sec. 2.  [EFFECTIVE DATE.] 
  2.18     This act is effective January 1, 2005.
