A bill for an act
relating to human services; setting parameters for the
Consumer-Directed Community Supports option for
persons with disabilities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

The state budget methodology for the Consumer-Directed
Community Supports option for all home and community-based
waiver programs for persons with disabilities under 65 years of
age will provide budget amounts of 95 percent of the amount that
would be paid to providers under the formula used by the
Department of Human Services to determine individual budget
amounts for waiver services. The methodology must be based on
the services and support intensity needed by eligible persons,
and must allow for exceptions to exceed the budget formula
amount when the individual's health, safety, or welfare cannot
be provided for under the formula.

The expenses allowed under the Consumer-Directed Community
Supports option shall include costs, including transportation,
associated with physical exercise or other physical activities
to maintain or improve the person's health and functioning.

The commissioner of human services shall submit an
amendment to the Centers for Medicare and Medicaid Services
consistent with sections 1 and 2 by August 1, 2005.

The commissioner of human services shall include in the
independent evaluation of the Consumer-Directed Community
Supports option provided through the home and community-based
services waivers for persons with disabilities under 65 years of
age:

(1) a review that involves participation by representatives
of stakeholders of the current unallowable expenditures; and

(2) recommendations on whether changes should be made to
meet the health, safety, and welfare needs of participants in
the Consumer-Directed Community Supports option within the
allowed budget amounts. The recommendations shall be provided
to the senate and house of representatives committees with
jurisdiction over human services policy and finance issues by
January 15, 2006.

Sections 1 and 2 are effective upon federal approval of the
waiver amendment in section 3. Sections 3 and 4 are effective
the day following final enactment.
