  1.1                          A bill for an act 
  1.2             relating to education; expanding subject matter of 
  1.3             teacher contract negotiations; amending Minnesota 
  1.4             Statutes 1998, sections 179A.03, subdivision 19; and 
  1.5             179A.07, subdivision 1. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 179A.03, 
  1.8   subdivision 19, is amended to read: 
  1.9      Subd. 19.  [TERMS AND CONDITIONS OF EMPLOYMENT.] "Terms and 
  1.10  conditions of employment" means the hours of employment, the 
  1.11  compensation therefor including fringe benefits except 
  1.12  retirement contributions or benefits other than employer payment 
  1.13  of, or contributions to, premiums for group insurance coverage 
  1.14  of retired employees or severance pay, and the employer's 
  1.15  personnel policies affecting the working conditions of the 
  1.16  employees.  In the case of professional employees the term does 
  1.17  not mean educational policies of a school district.  "Terms and 
  1.18  conditions of employment" is subject to section 179A.07.  
  1.19     Sec. 2.  Minnesota Statutes 1998, section 179A.07, 
  1.20  subdivision 1, is amended to read: 
  1.21     Subdivision 1.  [INHERENT MANAGERIAL POLICY.] A public 
  1.22  employer, excluding school districts, is not required to meet 
  1.23  and negotiate on matters of inherent managerial policy.  Matters 
  1.24  of inherent managerial policy include, but are not limited to, 
  1.25  such areas of discretion or policy as the functions and programs 
  2.1   of the employer, its overall budget, utilization of technology, 
  2.2   the organizational structure, selection of personnel, and 
  2.3   direction and the number of personnel.  No public employer shall 
  2.4   sign an agreement which limits its right to select persons to 
  2.5   serve as supervisory employees or state managers under section 
  2.6   43A.18, subdivision 3, or requires the use of seniority in their 
  2.7   selection.
