  1.1                          A bill for an act 
  1.2             relating to retirement; Minneapolis teachers 
  1.3             retirement fund association; including union business 
  1.4             agents in plan membership; proposing coding for new 
  1.5             law in Minnesota Statutes, chapter 354A. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [354A.051] [MINNEAPOLIS TEACHER RETIREMENT FUND 
  1.8   ASSOCIATION; COVERAGE FOR UNION BUSINESS AGENTS.] 
  1.9      (a) A person who previously was a member of the Minneapolis 
  1.10  teachers retirement fund association, who is on a leave of 
  1.11  absence from a teaching position with special school district 
  1.12  No. 1, Minneapolis, and who is employed as a business agent for 
  1.13  an employee organization representing Minneapolis teacher 
  1.14  retirement fund association active members may elect under 
  1.15  paragraph (b) to be a member of the coordinated program of the 
  1.16  association for service with that employee organization, subject 
  1.17  to the limitations set forth in paragraphs (c) and (d). 
  1.18     (b) A person described in paragraph (a) must be covered by 
  1.19  the coordinated program of the Minneapolis teachers retirement 
  1.20  fund association if the person files a written election to be 
  1.21  covered with the executive director of the Minneapolis teachers 
  1.22  retirement fund association before October 1, 1999, within 90 
  1.23  days of first being employed by the employee organization, or 
  1.24  within 90 days of the start of the first leave of absence for 
  1.25  service as an employee organization business agent, whichever is 
  2.1   later. 
  2.2      (c) The covered salary for an employee organization 
  2.3   business agent covered by the coordinated program of the 
  2.4   Minneapolis teachers retirement fund association under this 
  2.5   section is limited to the lesser of: 
  2.6      (1) the person's actual salary from the employee 
  2.7   organization as defined in section 354A.011, subdivision 24; or 
  2.8      (2) 75 percent of the salary of the governor as set under 
  2.9   section 15A.082. 
  2.10  The limited covered salary determined under this 
  2.11  paragraph must be used in determining member, employer, and 
  2.12  employer additional contributions under section 354A.12, and in 
  2.13  determining annuities and other benefits under sections 354A.30 
  2.14  to 354A.41 and chapter 356. 
  2.15     (d) A retirement annuity is only payable from the 
  2.16  coordinated program of the Minneapolis teachers retirement fund 
  2.17  association to a person described in paragraph (a), if the 
  2.18  person has met all applicable requirements, upon the termination 
  2.19  by the person of employment by the employee organization and by 
  2.20  special school district No. 1, Minneapolis.  The reemployed 
  2.21  annuitant earnings limitation set forth in section 354A.31, 
  2.22  subdivision 3, applies if the person retires and is subsequently 
  2.23  reemployed while an annuitant by the employee organization or by 
  2.24  any other entity employing persons who are members of the 
  2.25  Minneapolis teachers retirement fund association by virtue of 
  2.26  that employment. 
  2.27     (e) The member, employer, and employer additional 
  2.28  contributions required by section 354A.12 are the obligation of 
  2.29  the person who elects coverage by the coordinated program of the 
  2.30  Minneapolis teachers retirement fund association, but the 
  2.31  employee organization may pay the employer and employer 
  2.32  additional contributions.  Contributions made by the person must 
  2.33  be made by salary deduction.  Contributions made by the employee 
  2.34  organization must be made as provided in section 354A.12. 
  2.35     (f) A person employed by an employee organization who 
  2.36  becomes a member of the coordinated program of the Minneapolis 
  3.1   teachers retirement fund association is not eligible for 
  3.2   election to the board of trustees of the Minneapolis teachers 
  3.3   retirement fund association. 
  3.4      Sec. 2.  [EFFECTIVE DATE.] 
  3.5      Section 1 is effective the day following final enactment.
