  1.1                          A bill for an act 
  1.2             relating to civil actions; extending the municipal 
  1.3             tort claims protections to nonprofit firefighting 
  1.4             corporations; amending Minnesota Statutes 1994, 
  1.5             section 466.01, subdivisions 1 and 6. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 466.01, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [MUNICIPALITY.] For the purposes of 
  1.10  sections 466.01 to 466.15, "municipality" means any city, 
  1.11  whether organized under home rule charter or otherwise, any 
  1.12  county, town, public authority, public corporation, nonprofit 
  1.13  firefighting corporation that qualifies as a relief association 
  1.14  under section 424A.001, subdivision 4, special district, school 
  1.15  district, however organized, county agricultural society 
  1.16  organized pursuant to chapter 38, joint powers board or 
  1.17  organization created under section 471.59 or other statute, 
  1.18  public library, regional public library system, multicounty 
  1.19  multitype library system, other political subdivision, or 
  1.20  community action agency. 
  1.21     Sec. 2.  Minnesota Statutes 1994, section 466.01, 
  1.22  subdivision 6, is amended to read: 
  1.23     Subd. 6.  [EMPLOYEE, OFFICER, OR AGENT.] For the purposes 
  1.24  of sections 466.01 to 466.15, "employee," "officer," or "agent" 
  1.25  means a present or former employee, officer, or agent of a 
  2.1   municipality, or other person acting on behalf of the 
  2.2   municipality in an official capacity, temporarily or 
  2.3   permanently, with or without compensation, but does not include 
  2.4   an independent contractor other than a nonprofit firefighting 
  2.5   corporation that qualifies as a relief association under section 
  2.6   424A.001, subdivision 4.  "Employee" includes court 
  2.7   administrators and their staff under chapter 485, district 
  2.8   administration staff in the second and fourth judicial 
  2.9   districts, guardians ad litem, and other employees within the 
  2.10  court system whose salaries are paid by the county, other than 
  2.11  employees who remain on the county payroll under section 
  2.12  480.181, subdivision 2.
