  1.1                          A bill for an act 
  1.2             proposing an amendment to the Minnesota Constitution, 
  1.3             article V, section 5; changing the method of filling a 
  1.4             vacancy in the office of lieutenant governor. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [CONSTITUTIONAL AMENDMENT PROPOSED.] 
  1.7      An amendment to the Minnesota Constitution, article V, 
  1.8   section 5, is proposed to the people.  If the amendment is 
  1.9   adopted, the section will read as follows: 
  1.10     Sec. 5.  In case a vacancy occurs from any cause whatever 
  1.11  in the office of governor, the lieutenant governor shall be 
  1.12  governor during such vacancy.  The compensation of the 
  1.13  lieutenant governor shall be prescribed by law.  The last 
  1.14  elected presiding officer of the senate shall become lieutenant 
  1.15  governor in case a vacancy occurs in that office.  In case a 
  1.16  vacancy occurs in the office of lieutenant governor, the 
  1.17  governor shall fill the vacancy by appointment, with the advice 
  1.18  and consent of the senate and the house of representatives 
  1.19  acting separately.  In case the governor is unable to discharge 
  1.20  the powers and duties of his office, the same devolves on the 
  1.21  lieutenant governor.  The legislature may provide by law for the 
  1.22  case of the removal, death, resignation, or inability both of 
  1.23  the governor and lieutenant governor to discharge the duties of 
  1.24  governor and may provide by law for continuity of government in 
  1.25  periods of emergency resulting from disasters caused by enemy 
  2.1   attack in this state, including but not limited to, succession 
  2.2   to the powers and duties of public office and change of the seat 
  2.3   of government. 
  2.4      Sec. 2.  [SUBMISSION TO THE VOTERS.] 
  2.5      The proposed amendment must be submitted to the people at 
  2.6   the 1996 general election.  The question submitted shall be: 
  2.7      "Shall the Minnesota Constitution be amended to change the 
  2.8   method of filling a vacancy in the office of lieutenant governor?
  2.9                                      Yes .......
  2.10                                     No ........"
