  1.1                          A bill for an act 
  1.2             relating to detoxification services; requiring the 
  1.3             state to reimburse counties for services rendered; 
  1.4             amending Minnesota Statutes 2000, section 254A.08, by 
  1.5             adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 254A.08, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 1a.  [REIMBURSEMENT TO COUNTIES; STANDING 
  1.10  APPROPRIATION.] (a) On or before March 1, each county that 
  1.11  incurs detoxification costs under this section shall submit a 
  1.12  request for reimbursement to the commissioner of human services 
  1.13  on a form prescribed by the commissioner. 
  1.14     (b) Upon receipt of a request for reimbursement, the 
  1.15  commissioner, in consultation with the county, shall review the 
  1.16  request for accuracy.  If the commissioner determines that the 
  1.17  request is reasonable, accurate, and includes only those costs 
  1.18  associated with detoxification, the commissioner shall pay the 
  1.19  amount requested on or before June 1 of the year the request was 
  1.20  submitted.  If the amounts are estimated, this must be clearly 
  1.21  noted and actual data must be submitted for that year with the 
  1.22  following year's request.  The commissioner shall adjust the 
  1.23  following year's reimbursement to reflect the difference between 
  1.24  the estimated and actual prior year's costs. 
  1.25     (c) Notwithstanding section 3.24, an amount sufficient to 
  2.1   pay the reimbursements required by this subdivision is annually 
  2.2   appropriated from the general fund to the commissioner of human 
  2.3   services. 
  2.4      Sec. 2.  [EFFECTIVE DATE.] 
  2.5      Section 1 is effective July 1, 2001, and applies to costs 
  2.6   incurred on or after that date.
