  1.1                          A bill for an act 
  1.2             relating to education; modifying the organization of 
  1.3             the Minnesota school-to-work student organization; 
  1.4             appropriating money; amending Minnesota Statutes 1996, 
  1.5             section 121.615, subdivisions 2, 3, 5, 6, 7, 8, 9, and 
  1.6             10. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1996, section 121.615, 
  1.9   subdivision 2, is amended to read: 
  1.10     Subd. 2.  [CREATION OF FOUNDATION.] There is created the 
  1.11  Minnesota school-to-work student organization foundation.  The 
  1.12  purpose of the foundation shall be to promote vocational student 
  1.13  organizations and applied leadership opportunities in Minnesota 
  1.14  public and nonpublic schools through public-private 
  1.15  partnerships.  The foundation shall be a nonprofit 
  1.16  organization.  The board of directors of the foundation and 
  1.17  activities of the foundation are under the direction of 
  1.18  the department of children, families, and learning state board 
  1.19  of education.  
  1.20     Sec. 2.  Minnesota Statutes 1996, section 121.615, 
  1.21  subdivision 3, is amended to read: 
  1.22     Subd. 3.  [BOARD OF DIRECTORS.] The board of directors of 
  1.23  the school-to-work student organization foundation shall consist 
  1.24  of: 
  1.25     (1) chairs or designees from the board of directors of FFA 
  1.26  (formerly Future Farmers of America), Future Leaders of 
  2.1   America/Future Homemakers of America, post-secondary agriculture 
  2.2   students, home economics related occupations, Health Occupations 
  2.3   Student Association, Distributive Education Clubs of America, 
  2.4   Delta Upsilon Chi, Secondary Vocational Industrial Clubs of 
  2.5   America, Post-secondary Vocational Industrial Clubs of America, 
  2.6   Secondary Business Professionals of America, and Post-secondary 
  2.7   Business Professionals of America; 
  2.8      (2) four members from business and industry appointed by 
  2.9   the governor; and 
  2.10     (3) five students representing diverse vocational areas, 
  2.11  three of whom are appointed by the commissioner of the 
  2.12  department of children, families, and learning and two of whom 
  2.13  are appointed by the chancellor of the Minnesota state colleges 
  2.14  and universities with the advice of the executive councils of 
  2.15  each vocational education student organization. 
  2.16     (1) seven members appointed by the board of directors of 
  2.17  the school-to-work student organizations and chosen so that each 
  2.18  represents one of the following career areas:  agriculture, 
  2.19  family and consumer sciences, service occupations, health 
  2.20  occupations, marketing, business, and technical/industrial; 
  2.21     (2) seven members from business, industry, and labor 
  2.22  appointed by the governor to staggered terms and chosen so that 
  2.23  each represents one of the following career areas:  agriculture, 
  2.24  family and consumer sciences, service occupations, health 
  2.25  occupations, marketing, business, and technical/industrial; 
  2.26     (3) five students or alumni of school-to-work student 
  2.27  organizations representing diverse career areas, three from 
  2.28  secondary student organizations, and two from post-secondary 
  2.29  student organizations.  The students or alumni shall be 
  2.30  appointed by the criteria and process agreed upon by the 
  2.31  executive directors of the student-to-work organizations; and 
  2.32     (4) four members from education appointed by the governor 
  2.33  to staggered terms and chosen so that each represents one of the 
  2.34  following groups:  school district level administrators, 
  2.35  secondary school administrators, middle school administrators, 
  2.36  and post-secondary administrators. 
  3.1      Executive directors of vocational education student 
  3.2   organizations are ex officio, nonvoting members of the board. 
  3.3      Sec. 3.  Minnesota Statutes 1996, section 121.615, 
  3.4   subdivision 5, is amended to read: 
  3.5      Subd. 5.  [POWERS AND DUTIES.] The foundation may: 
  3.6      (1) identify and plan common goals and priorities for the 
  3.7   various school-to-work student organizations in Minnesota; 
  3.8      (2) publish brochures or booklets relating to the purposes 
  3.9   of the foundation and collect reasonable fees for the 
  3.10  publications; 
  3.11     (3) seek and receive public and private money, grants, and 
  3.12  in-kind services and goods from nonstate sources for the 
  3.13  purposes of the foundation, without complying with section 7.09, 
  3.14  subdivision 1; 
  3.15     (4) contract with consultants on behalf of the 
  3.16  school-to-work student organizations; and 
  3.17     (5) plan, implement, and expend money for awards and other 
  3.18  forms of recognition for school-to-work student activities; and 
  3.19     (6) identifying an appropriate name for the foundation. 
  3.20     Sec. 4.  Minnesota Statutes 1996, section 121.615, 
  3.21  subdivision 6, is amended to read: 
  3.22     Subd. 6.  [CONTRACTS.] The foundation board of directors 
  3.23  shall review and approve foundation personnel and programming 
  3.24  contracts each contract of the board.  Each contract of the 
  3.25  foundation board shall be subject to the same review and 
  3.26  approval procedures as a contract of the state board of 
  3.27  education. 
  3.28     Sec. 5.  Minnesota Statutes 1996, section 121.615, 
  3.29  subdivision 7, is amended to read: 
  3.30     Subd. 7.  [FOUNDATION STAFF.] The commissioner of the 
  3.31  department of children, families, and learning state board of 
  3.32  education shall appoint the executive director of the foundation 
  3.33  from three candidates nominated and submitted by the foundation 
  3.34  board of directors and, as necessary, other staff who shall 
  3.35  perform duties and have responsibilities solely related to the 
  3.36  foundation.  The employees appointed are not state employees 
  4.1   under chapter 43A, but are covered under section 3.736.  The 
  4.2   employees may participate in the state health and state 
  4.3   insurance plans for employees in unclassified service.  The 
  4.4   employees shall be supervised by the executive director. 
  4.5      The commissioner shall appoint from the office of lifework 
  4.6   development a liaison to the foundation board. 
  4.7      Sec. 6.  Minnesota Statutes 1996, section 121.615, 
  4.8   subdivision 8, is amended to read: 
  4.9      Subd. 8.  [PUBLIC FUNDING.] The commissioner of the 
  4.10  department of children, families, and learning state shall 
  4.11  identify and secure appropriate sources of state and federal 
  4.12  funding from various state agencies, including, but not limited 
  4.13  to, Minnesota state colleges and universities, for the operation 
  4.14  and development of basic staffing of the foundation and 
  4.15  individual student school-to-work student organizations. 
  4.16     Sec. 7.  Minnesota Statutes 1996, section 121.615, 
  4.17  subdivision 9, is amended to read: 
  4.18     Subd. 9.  [PRIVATE FUNDING.] The foundation shall seek 
  4.19  private resources to supplement the allocated state and 
  4.20  federal available public money.  Individuals, businesses, and 
  4.21  other organizations may contribute to the foundation in any 
  4.22  manner specified by the board of directors.  All money received 
  4.23  shall be administered by the board of directors. 
  4.24     Sec. 8.  Minnesota Statutes 1996, section 121.615, 
  4.25  subdivision 10, is amended to read: 
  4.26     Subd. 10.  [REPORT.] The board of directors of the 
  4.27  foundation shall submit an annual report and assessment to the 
  4.28  office of lifework development and on the progress of its 
  4.29  activities to the state board of education and to the board of 
  4.30  trustees of the Minnesota state colleges and universities.  The 
  4.31  annual report shall contain a financial report for the preceding 
  4.32  year.  The foundation shall submit a biennium report to the 
  4.33  legislature before February 15, in the odd-numbered year. 
  4.34     Sec. 9.  [APPROPRIATION.] 
  4.35     $500,000 in fiscal year 1998 and $500,000 in fiscal year 
  4.36  1999 is appropriated from the general fund to the commissioner 
  5.1   of children, families, and learning for the Minnesota 
  5.2   school-to-work student organization foundation under Minnesota 
  5.3   Statutes, section 121.615.
