  1.1                          A bill for an act 
  1.2             relating to public defense; providing for the salary 
  1.3             of the state public defender; amending Minnesota 
  1.4             Statutes 2000, sections 15A.083, subdivision 4; and 
  1.5             611.23. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 15A.083, 
  1.8   subdivision 4, is amended to read: 
  1.9      Subd. 4.  [RANGES FOR OTHER JUDICIAL POSITIONS.] Salaries 
  1.10  or salary ranges are provided for the following positions in the 
  1.11  judicial branch of government.  The appointing authority of any 
  1.12  position for which a salary range has been provided shall fix 
  1.13  the individual salary within the prescribed range, considering 
  1.14  the qualifications and overall performance of the employee.  The 
  1.15  supreme court shall set the salary of the state court 
  1.16  administrator and the salaries of district court 
  1.17  administrators.  The salary of the state court administrator or 
  1.18  a district court administrator may not exceed the salary of a 
  1.19  district court judge.  If district court administrators die, the 
  1.20  amounts of their unpaid salaries for the months in which their 
  1.21  deaths occur must be paid to their estates.  The salary of the 
  1.22  state public defender must be 95 percent of the salary of the 
  1.23  attorney general shall be fixed by the state board of public 
  1.24  defense but must not exceed the salary of a district court judge.

  2.5      Sec. 2.  Minnesota Statutes 2000, section 611.23, is 
  2.6   amended to read: 
  2.7      611.23 [OFFICE OF STATE PUBLIC DEFENDER; APPOINTMENT; 
  2.8   SALARY.] 
  2.9      The state public defender is responsible to the state board 
  2.10  of public defense.  The state public defender shall be appointed 
  2.11  by the state board of public defense for a term of four years, 
  2.12  except as otherwise provided in this section, and until a 
  2.13  successor is appointed and qualified.  The state public defender 
  2.14  shall be a full-time qualified attorney, licensed to practice 
  2.15  law in this state, serve in the unclassified service of the 
  2.16  state, and be removed only for cause by the appointing 
  2.17  authority.  Vacancies in the office shall be filled by the 
  2.18  appointing authority for the unexpired term.  The salary of the 
  2.19  state public defender shall be fixed by the state board of 
  2.20  public defense but must not exceed the salary of the chief 
  2.21  deputy attorney general a district court judge.  Terms of the 
  2.22  state public defender shall commence on July 1.  The state 
  2.23  public defender shall devote full time to the performance of 
  2.24  duties and shall not engage in the general practice of law.
