  1.1                          A bill for an act 
  1.2             relating to education; creating high performance 
  1.3             school facilities pilot projects in independent school 
  1.4             districts Nos. 728 and 535, Elk River and Rochester; 
  1.5             requiring an integrated facilities plan; appropriating 
  1.6             money. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [HIGH PERFORMANCE SCHOOL FACILITIES PILOT 
  1.9   PROJECTS.] 
  1.10     Subdivision 1.  [PURPOSE.] High performance school 
  1.11  facilities pilot projects, phase 1, are created for the purpose 
  1.12  of defining and demonstrating the effectiveness of high 
  1.13  performance schools as a solution to the need for simpler school 
  1.14  buildings with lower life cycle costs.  This is a two-phase 
  1.15  project.  The scope of work in phase 1 defines the planning, 
  1.16  design, and process changes required to achieve high performing 
  1.17  schools.  Phase 2 includes implementing the improvements to 
  1.18  facilities and changes to process defined in phase 1.  
  1.19     Subd. 2.  [GOALS.] The goals of high performance school 
  1.20  facilities pilot projects are to: 
  1.21     (1) allow school districts to shift the investment of 
  1.22  tax-generated school revenues from utility bills and excessive 
  1.23  maintenance repair costs to investing in Minnesota students; 
  1.24     (2) reduce the life cycle costs of schools; and 
  1.25     (3) promote overall improvement in school building quality. 
  1.26     Subd. 3.  [INDEPENDENT SCHOOL DISTRICT NO. 728, ELK 
  2.1   RIVER.] (a) Independent school district No. 728, Elk River, may 
  2.2   design and build a new school facility based on high performance 
  2.3   design principles. 
  2.4      (b) Independent school district No. 728, Elk River, must: 
  2.5      (1) work in partnership with the department of children, 
  2.6   families, and learning and independent school district No. 535, 
  2.7   Rochester, to establish High Performance Schools Minnesota; 
  2.8      (2) incorporate high performance building design strategies 
  2.9   and benchmarks, as defined in the duty book for the new high 
  2.10  school in Rogers, into the design and construction of a new 
  2.11  school facility; 
  2.12     (3) document and report to the department of children, 
  2.13  families, and learning on the design and construction of the new 
  2.14  school facility, describing in detail the costs and benefits of 
  2.15  using high performance design strategies within the constraints 
  2.16  of new construction; and 
  2.17     (4) produce an integrated facility plan that creates an 
  2.18  overarching plan defining clear timelines for ongoing facility 
  2.19  optimization, maintenance, improvement, and repair. 
  2.20     Subd. 4.  [INDEPENDENT SCHOOL DISTRICT NO. 535, 
  2.21  ROCHESTER.] (a) Independent school district No. 535, Rochester, 
  2.22  may remodel an existing school facility based on high 
  2.23  performance design principles. 
  2.24     (b) Independent school district No. 535, Rochester, must: 
  2.25     (1) work in partnership with the department of children, 
  2.26  families, and learning and independent school district No. 728, 
  2.27  Elk River, to establish High Performance Schools Minnesota; 
  2.28     (2) incorporate high performance building design strategies 
  2.29  into the remodeling of an existing school facility; 
  2.30     (3) document and report to the department of children, 
  2.31  families, and learning on the school facility remodeling, 
  2.32  describing in detail the costs and benefits of using high 
  2.33  performance design strategies within the constraints of 
  2.34  remodeling an existing school facility; and 
  2.35     (4) produce an integrated facility plan that creates an 
  2.36  overarching plan defining clear timelines for ongoing facility 
  3.1   optimization, maintenance, improvement, and repair. 
  3.2      Subd. 5.  [DIRECTION TO DEPARTMENT OF CHILDREN, FAMILIES, 
  3.3   AND LEARNING.] (a) The department of children, families, and 
  3.4   learning must report to the legislative committees responsible 
  3.5   for kindergarten through grade 12 education by February 15, 
  3.6   2003.  The report must: 
  3.7      (1) document the overall approach used in the high 
  3.8   performance school strategies used in independent school 
  3.9   districts Nos. 728 and 535, Elk River and Rochester; 
  3.10     (2) create and document a model for school districts 
  3.11  throughout Minnesota to use that defines both the processes and 
  3.12  outcomes of designing, constructing, and operating high 
  3.13  performance schools in Minnesota; 
  3.14     (3) identify barriers to adopting high performance design 
  3.15  strategies and practices within state government and recommend 
  3.16  strategies for eliminating these barriers, including incentives 
  3.17  that would reward high performance schools; 
  3.18     (4) identify the most innovative and cost-effective siting, 
  3.19  design, construction, maintenance, and operations practices in 
  3.20  use that are suited to Minnesota's climate; 
  3.21     (5) document cost and performance information on the high 
  3.22  performance schools practices; 
  3.23     (6) integrate the innovative and cost-effective high 
  3.24  performance schools strategies into the review and comment 
  3.25  process under section 123B.71; and 
  3.26     (7) make recommendations on the referendum and bonding 
  3.27  process so that final decisions reward school districts that 
  3.28  make a commitment to high performance school design. 
  3.29     (b) The department must serve as overall project 
  3.30  coordinator for the pilot projects under subdivisions 3 and 4. 
  3.31     Subd. 6.  [INTEGRATED FACILITY PLAN.] (a) School districts 
  3.32  must submit an integrated facility plan to the department of 
  3.33  children, families, and learning for approval prior to beginning 
  3.34  a high performance school facilities construction or remodeling 
  3.35  project.  The integrated facility plan must: 
  3.36     (1) determine the timelines for the use of new and existing 
  4.1   facilities; 
  4.2      (2) establish benchmarks for building performance; and 
  4.3      (3) establish goals for constructing new facilities or 
  4.4   remodeling existing facilities. 
  4.5      (b) School districts must submit integrated facility plans 
  4.6   to the department according to the timelines and on the forms 
  4.7   provided by the department. 
  4.8      (c) The department may refuse any integrated facility plan 
  4.9   that does not meet the specifications of this subdivision. 
  4.10     [EFFECTIVE DATE.] This section is effective July 1, 2001. 
  4.11     Sec. 2.  [APPROPRIATION.] 
  4.12     $500,000 is appropriated in fiscal year 2002 from the 
  4.13  general fund to the commissioner of children, families, and 
  4.14  learning for the high performance school facilities pilot 
  4.15  projects.  Of this amount, $260,000 is for independent school 
  4.16  district No. 728, Elk River; $190,000 is for independent school 
  4.17  district No. 535, Rochester; and $50,000 is for the department 
  4.18  of children, families, and learning for the coordination and 
  4.19  reporting requirements of the high performance school facilities 
  4.20  pilot projects. 
  4.21     [EFFECTIVE DATE.] This section is effective July 1, 2001.
