  1.1                          A bill for an act 
  1.2             relating to human services; under certain 
  1.3             circumstances requiring residency in the state for 60 
  1.4             days before applying for work readiness or general 
  1.5             assistance; proposing coding for new law in Minnesota 
  1.6             Statutes, section 256D; repealing Minnesota Statutes 
  1.7             1994, section 256D.065.  
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [256D.066] [GENERAL ASSISTANCE AND WORK 
  1.10  READINESS PAYMENTS.] 
  1.11     Notwithstanding other provisions of sections 256D.01 to 
  1.12  256D.21, otherwise eligible applicants without children must 
  1.13  have resided in this state for at least 60 consecutive days 
  1.14  before applying for work readiness or general assistance 
  1.15  benefits.  This requirement does not apply if the person resides 
  1.16  in this state and meets any of the following conditions: 
  1.17     (1) The person was born in this state. 
  1.18     (2) The person has, in the past, resided in this state for 
  1.19  at least 365 consecutive days. 
  1.20     (3) The person came to this state to join a close relative 
  1.21  who has resided in this state for at least 180 days before the 
  1.22  arrival of the person.  For purposes of this section, "close 
  1.23  relative" means the person's parent, grandparent, brother, 
  1.24  sister, spouse, or child. 
  1.25     (4) The person came to this state to accept a bona fide 
  1.26  offer of employment and the person was eligible to accept the 
  2.1   employment. 
  2.2      A county agency may waive this requirement in cases of 
  2.3   medical emergency or where unusual misfortune or hardship would 
  2.4   result from denial of assistance.  All waivers under this 
  2.5   section shall be reported to the commissioner in 30 days. 
  2.6      Sec. 2.  [REPEALER.] 
  2.7      Minnesota Statutes 1994, section 256D.065, is repealed.
