  1.1                          A bill for an act 
  1.2             relating to crime prevention; prohibiting certain 
  1.3             types of racing; prohibiting individuals from being 
  1.4             spectators at illegal races; imposing criminal 
  1.5             penalties; amending Minnesota Statutes 2002, section 
  1.6             169.13, by adding a subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 169.13, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 2a.  [UNLAWFUL RACING.] (a) As used in this 
  1.11  subdivision, "race" means the operation of one or more vehicles 
  1.12  in a competitive attempt to: 
  1.13     (1) outgain or outdistance another vehicle; 
  1.14     (2) arrive at a given destination ahead of another vehicle; 
  1.15     (3) engage in a speed or acceleration contest; 
  1.16     (4) set a speed record; or 
  1.17     (5) test the physical stamina or endurance of a driver or 
  1.18  drivers over long-distance driving routes. 
  1.19     (b) A person who drives a vehicle in a race or who 
  1.20  organizes or otherwise facilitates a race is guilty of a 
  1.21  misdemeanor. 
  1.22     (c) A person who observes, watches, or otherwise acts as a 
  1.23  spectator to a race that is illegal under this subdivision is 
  1.24  guilty of a petty misdemeanor. 
  1.25     (d) This subdivision does not apply to acts sanctioned by 
  1.26  an appropriate governmental entity that occur in areas that are 
  2.1   licensed or duly authorized by the entity as a racetrack, drag 
  2.2   strip, or designated racing area. 
  2.3      Sec. 2.  [EFFECTIVE DATE.] 
  2.4      Section 1 is effective August 1, 2004, and applies to acts 
  2.5   committed on or after that date.
