1.1 A bill for an act 1.2 relating to public safety; defining certain employees 1.3 of the commissioner of public safety as public safety 1.4 officers for purposes of public safety officer's 1.5 survivor benefits; amending Minnesota Statutes 2000, 1.6 section 299A.41, subdivision 4. 1.7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.8 Section 1. Minnesota Statutes 2000, section 299A.41, 1.9 subdivision 4, is amended to read: 1.10 Subd. 4. [PUBLIC SAFETY OFFICER.] "Public safety officer" 1.11 includes: 1.12 (1) a peace officer defined in section 626.84, subdivision 1.13 1, paragraph (c) or (f); 1.14 (2) a correction officer employed at a correctional 1.15 facility and charged with maintaining the safety, security, 1.16 discipline, and custody of inmates at the facility; 1.17 (3) an individual employed on a full-time basis by the 1.18 state or by a fire department of a governmental subdivision of 1.19 the state, who is engaged in any of the following duties: 1.20 (i) firefighting; 1.21 (ii) emergency motor vehicle operation; 1.22 (iii) investigation into the cause and origin of fires; 1.23 (iv) the provision of emergency medical services; or 1.24 (v) hazardous material responder; 1.25 (4) a legally enrolled member of a volunteer fire 1.26 department or member of an independent nonprofit firefighting 2.1 corporation who is engaged in the hazards of firefighting; 2.2 (5) a good samaritan while complying with the request or 2.3 direction of a public safety officer to assist the officer; 2.4 (6) a reserve police officer or a reserve deputy sheriff 2.5 while acting under the supervision and authority of a political 2.6 subdivision; 2.7 (7) a driver or attendant with a licensed basic or advanced 2.8 life support transportation service who is engaged in providing 2.9 emergency care;and2.10 (8) a first responder who is certified by the commissioner 2.11 of health to perform basic emergency skills before the arrival 2.12 of a licensed ambulance service and who is a member of an 2.13 organized service recognized by a local political subdivision to 2.14 respond to medical emergencies to provide initial medical care 2.15 before the arrival of an ambulance; and 2.16 (9) a person employed by the commissioner of public safety 2.17 and assigned to the state patrol, whose primary employment is 2.18 the enforcement of commercial motor vehicle laws and regulations.
