  1.1                          A bill for an act 
  1.2             relating to local government; requiring that local 
  1.3             governments acquire construction easements, permits, 
  1.4             and other rights to use property in a timely fashion; 
  1.5             proposing coding for new law in Minnesota Statutes, 
  1.6             chapter 471. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [471.347] [CONSTRUCTION CONTRACTS; REQUIRED 
  1.9   EASEMENTS.] 
  1.10     When a home rule charter or statutory city, county, town, 
  1.11  school district, or other municipal corporation or political 
  1.12  subdivision of this state contracts for the construction of a 
  1.13  project that requires the unit to acquire easements, permits, or 
  1.14  other rights to use real property, the unit shall acquire all of 
  1.15  those easements, permits, or other rights before awarding the 
  1.16  contract.  A unit that violates this section is liable to an 
  1.17  affected contractor for all the costs that the contractor incurs 
  1.18  by reason of the violation.
