  1.1                          A bill for an act 
  1.2             relating to community dispute resolution; excluding 
  1.3             certain disputes and matters from being accepted for 
  1.4             resolution by a community dispute resolution program; 
  1.5             amending Minnesota Statutes 1994, section 494.03. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 494.03, is 
  1.8   amended to read: 
  1.9      494.03 [EXCLUSIONS.] 
  1.10     The guidelines shall exclude:  
  1.11     (1) any dispute involving violence against persons, 
  1.12  including in which incidents arising out of situations that 
  1.13  would support charges under sections 609.221 to 609.2231, 
  1.14  609.342 to 609.345, or 609.365, or any other felony charges; 
  1.15     (2) any matter involving a person who has been adjudicated 
  1.16  incompetent or relating to guardianship, 
  1.17  conservatorship competency, or civil commitment; 
  1.18     (3) any matter involving a person who has been adjudicated 
  1.19  incompetent or relating to guardianship or conservatorship 
  1.20  unless the incompetent person is accompanied by a competent 
  1.21  advocate or the respondent in a guardianship or conservatorship 
  1.22  matter is represented by an attorney, guardian ad litum, or 
  1.23  other representative appointed by the court; 
  1.24     (4) any matter involving neglect or dependency, or 
  1.25  involving termination of parental rights arising under sections 
  2.1   260.221 to 260.245; and 
  2.2      (4) (5) any matter arising under section 626.557 or 
  2.3   sections 144.651 to 144.652, or any dispute subject to chapters 
  2.4   518, 518A, and 518B, and 518C, whether or not an action is 
  2.5   pending, except for postdissolution property distribution 
  2.6   matters and postdissolution visitation matters.  This shall not 
  2.7   restrict the present authority of the court or departments of 
  2.8   the court from accepting for resolution a dispute arising under 
  2.9   chapters 518, 518A, and 518C 518B, or from referring disputes 
  2.10  arising under chapters 518, and 518A to for-profit mediation.
