  1.1                          A bill for an act 
  1.2             relating to education; providing for establishment of 
  1.3             single-member school board election districts in 
  1.4             Independent School District No. 279, Osseo. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [OSSEO SCHOOL ELECTION DISTRICTS.] 
  1.7      Subdivision 1.  [ELECTION.] The school board of Independent 
  1.8   School District No. 279, Osseo, must divide the school district 
  1.9   into single-member election districts, from which one board 
  1.10  member each must be elected. 
  1.11     Subd. 2.  [ELECTION DISTRICT BOUNDARIES.] Each election 
  1.12  district must be as equal in population as practicable and must 
  1.13  be composed of compact, contiguous territory.  The district may 
  1.14  use the most recent federal decennial census figures available 
  1.15  or may conduct a special census for this purpose.  The board 
  1.16  shall designate each election district by number. 
  1.17     Subd. 3.  [BOARD ELECTIONS.] The board shall specify the 
  1.18  election districts from which vacancies shall be filled as they 
  1.19  occur until such time as each board member represents an 
  1.20  election district.  A candidate for school board in a subsequent 
  1.21  election must file an affidavit of candidacy to be elected as a 
  1.22  school board member for the election district in which the 
  1.23  candidate resides.  Each board member must be a resident of the 
  1.24  election district for which elected but the creation of an 
  1.25  election district or a change in election district boundaries 
  2.1   shall not disqualify a board member from serving for the 
  2.2   remainder of a term. 
  2.3      Sec. 2.  [LOCAL APPROVAL.] 
  2.4      This act is effective the day after the governing body of 
  2.5   Independent School District No. 279, Osseo, and its chief 
  2.6   clerical officer comply with Minnesota Statutes, section 
  2.7   645.021, subdivisions 2 and 3.  If local approval has not been 
  2.8   completed by July 1, 2004, the governing body shall submit the 
  2.9   question of approval to the voters of the school district at the 
  2.10  2004 general election.  The question submitted must be: 
  2.11     "Shall Independent School District No. 279, Osseo, be 
  2.12  divided into six election districts, from which one member each 
  2.13  must be elected?" 
  2.14     If approved by a majority of the voters voting on the 
  2.15  question, this act is effective the day after the canvassing 
  2.16  board certifies the result of the election.
