  1.1                          A bill for an act 
  1.2             relating to public safety; authorizing payments to 
  1.3             metropolitan airports commission for 911 emergency 
  1.4             services; amending Minnesota Statutes 1996, section 
  1.5             403.113, subdivision 2. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 403.113, 
  1.8   subdivision 2, is amended to read: 
  1.9      Subd. 2.  [DISTRIBUTION OF MONEY.] (a) After payment of the 
  1.10  costs of the department of administration to administer the 
  1.11  program, the commissioner shall distribute the money collected 
  1.12  under this section as follows: 
  1.13     (1) one-half of the amount equally to all qualified 
  1.14  counties and the metropolitan airports commission; and 
  1.15     (2) the remaining one-half to qualified counties and cities 
  1.16  with existing 911 systems based on each county's or city's 
  1.17  percentage of the total population of qualified counties and 
  1.18  cities.  The population of a qualified city with an existing 
  1.19  system must be deducted from its county's population when 
  1.20  calculating the county's share under this clause if the city 
  1.21  seeks direct distribution of its share. 
  1.22     (b) A county's share under subdivision 1 must be shared pro 
  1.23  rata between the county and existing city systems in the 
  1.24  county.  A county or city shall deposit money received under 
  1.25  this subdivision in an interest-bearing fund or account separate 
  2.1   from the county's or city's general fund and may use money in 
  2.2   the fund or account only for the purposes specified in 
  2.3   subdivision 3. 
  2.4      (c) For the purposes of this subdivision, a county or city 
  2.5   is qualified to share in the distribution of money for enhanced 
  2.6   911 service if the county auditor certifies to the commissioner 
  2.7   of administration the amount of the county's or city's levy for 
  2.8   the cost of providing enhanced 911 service for taxes payable in 
  2.9   the year in which money for enhanced 911 service will be 
  2.10  distributed.  The commissioner may not distribute money to a 
  2.11  county or city in an amount greater than twice the amount of the 
  2.12  county's or city's certified levy.  A county or city is not 
  2.13  qualified to share in the distribution of money for enhanced 911 
  2.14  service if, in addition to the levy required under this 
  2.15  paragraph, it has not implemented enhanced 911 service before 
  2.16  December 31, 1998. 
  2.17     (d) For the purposes of this subdivision, "existing city 
  2.18  system" means a city 911 system that provides at least basic 911 
  2.19  service and that was implemented on or before April 1, 1993.
