A bill for an act
relating to economic development; transferring unused appropriations to an
account for the small cities development program to be used by communities
affected by storms and flooding in 2012.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

new text begin (a) The unexpended and unencumbered balance of the appropriations in Laws 2012,
First Special Session chapter 1, article 1, section 5, as amended by Laws 2012, First
Special Session chapter 2, section 1; and Laws 2012 First Special Session chapter 1,
article 1, section 7, estimated to be $......, are transferred to an account in the state treasury
to be administered by the commissioner of employment and economic development in
accordance with the provisions of the Small Cities Development Block Grant Program
under Minnesota Rules, chapter 4300.

new text begin (b) Money transferred to this account is dedicated to provide relief for communities
affected by the storms and flooding that occurred on or after June 14, 2012, in the area in
Minnesota designated under Presidential Declaration of a Major Disaster FEMA-4069-DR,
whether included in the original declaration or added later by federal government action.

new text begin (c) Notwithstanding any law or rule to the contrary, money transferred to this
account may also be used by the commissioner for grants to local units of government as
a source of interim financing for local units of government having cash flow problems
due to funding public infrastructure projects that are reimbursed by Federal Emergency
Management Agency (FEMA) funds.

new text begin (d) Notwithstanding Minnesota Statutes, section 16A.28, money transferred to this
account does not lapse and is available until spent.
