  1.1                          A bill for an act 
  1.2             relating to capital improvements; defining design and 
  1.3             predesign; amending Minnesota Statutes 1996, section 
  1.4             16B.335, subdivision 3. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1996, section 16B.335, 
  1.7   subdivision 3, is amended to read: 
  1.8      Subd. 3.  [PREDESIGN REQUIREMENT.] For purposes of this 
  1.9   section, the following terms have the meanings given them. 
  1.10     (a) "Predesign" means the highly focused planning process 
  1.11  that defines the scope, cost, and schedule of the complete 
  1.12  project and provides instructions to design professionals.  
  1.13  Predesign plans must include sufficient detail to demonstrate 
  1.14  that all elements necessary to make the project functional are 
  1.15  included and that the project has been analyzed according to 
  1.16  appropriate space needs standards. 
  1.17     (b) "Design" means the set of activities contained in the 
  1.18  architectural contract, including schematics, design 
  1.19  development, and contract documents. 
  1.20     (c) A recipient to whom an appropriation is made for a 
  1.21  project subject to review under subdivision 1 or notice under 
  1.22  subdivision 2 shall prepare a predesign package and submit it to 
  1.23  the commissioner for review and recommendation before proceeding 
  1.24  with design activities.  The commissioner must complete the 
  1.25  review and recommendation within ten working days after 
  2.1   receiving it.  Failure to review and recommend within the ten 
  2.2   days is considered a positive recommendation.  The predesign 
  2.3   package must be sufficient to define the scope, cost, and 
  2.4   schedule of the project and must demonstrate that the project 
  2.5   has been analyzed according to appropriate space needs standards.
  2.6      Sec. 2.  [EFFECTIVE DATE.] 
  2.7      This act is effective the day following final enactment.
