  1.1                          A bill for an act 
  1.2             relating to human services; establishing a task force 
  1.3             to develop a new day training and habilitation payment 
  1.4             rate structure with technical assistance from the 
  1.5             commissioner of human services. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [TASK FORCE.] 
  1.8      A day training and habilitation task force is established.  
  1.9   Task force membership shall consist of representatives of 
  1.10  counties, service consumers, and vendors of day training and 
  1.11  habilitation as defined in Minnesota Statutes, section 252.41, 
  1.12  subdivision 9, including at least one representative from each 
  1.13  association representing day training and habilitation vendors.  
  1.14  Appointments to the task force shall be made by the commissioner 
  1.15  of human services and technical assistance shall be provided by 
  1.16  the department of human services. 
  1.17     Sec. 2.  [PAYMENT STRUCTURE.] 
  1.18     The task force shall develop a new payment rate structure 
  1.19  for day training and habilitation services that reflects 
  1.20  individual consumer needs and demands for services.  The payment 
  1.21  structure shall be based on individual need, flexibility, and 
  1.22  simplicity in administration and a reflection of costs.  An 
  1.23  equitable distribution of funds based on need shall be ensured. 
  1.24     Sec. 3.  [OPTIONS.] 
  1.25     The task force shall explore the following options as they 
  2.1   relate to the payment rate structure for day training and 
  2.2   habilitation services:  waivered services, existing pilot 
  2.3   projects, hourly rates, regional rates, performance-based 
  2.4   contracting, and day training and habilitation vendors as 
  2.5   medical assistance providers.  The task force shall consider 
  2.6   additional issues related to the payment rate structure which 
  2.7   shall include but not be limited to the following:  
  2.8   transportation, disparity of rates among day training and 
  2.9   habilitation programs, payment based on clients' enrollment in a 
  2.10  day training and habilitation program rather than attendance at 
  2.11  the program, consumers' transition from school to work, and 
  2.12  capital improvement needs of day training and habilitation 
  2.13  programs' physical facilities. 
  2.14     Sec. 4.  [REPORT.] 
  2.15     The task force shall present a report recommending a new 
  2.16  payment rate structure to the legislature by January 15, 2000.  
  2.17  The task force expires on March 15, 2000. 
  2.18     Sec. 5.  [EFFECTIVE DATE.] 
  2.19     Sections 1 to 4 are effective the day following final 
  2.20  enactment.
