1.1 A bill for an act 1.2 relating to capital improvements; authorizing spending 1.3 to acquire and to better public buildings and other 1.4 public improvements of a capital nature; providing for 1.5 the commissioner of the Department of Education to 1.6 issue library capital improvement grants; authorizing 1.7 issuance of bonds; appropriating money; amending 1.8 Minnesota Statutes 2002, section 134.45, subdivision 1.9 5; Minnesota Statutes 2003 Supplement, section 134.45, 1.10 subdivisions 1, 2. 1.11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.12 Section 1. Minnesota Statutes 2003 Supplement, section 1.13 134.45, subdivision 1, is amended to read: 1.14 Subdivision 1. [APPLICATION; DEFINITION.] Public library 1.15 jurisdictions may apply to the commissioner of education for 1.16 grants to improveaccessibility totheir library facilities. 1.17 For the purposes of this section, "public library jurisdictions" 1.18 means regional public library systems, regional library 1.19 districts, cities, and counties operating libraries under 1.20 chapter 134. 1.21 Sec. 2. Minnesota Statutes 2003 Supplement, section 1.22 134.45, subdivision 2, is amended to read: 1.23 Subd. 2. [APPROVAL BY COMMISSIONER.] The commissioner of 1.24 education, in consultation with the state Council on Disability, 1.25 may approve or disapprove applications under this section. The 1.26 grant money must be usedonlyto remove architectural barriers 1.27 from a building or site, to renovate or expand an existing 1.28 building for use as a library, or to construct a new library 2.1 building. 2.2 Sec. 3. Minnesota Statutes 2002, section 134.45, 2.3 subdivision 5, is amended to read: 2.4 Subd. 5. [QUALIFICATION.] A public library jurisdiction 2.5 may apply for a grant in an amount up to$150,000$1,000,000 or 2.6 50 percent of the approved costsof removing architectural2.7barriers from a building or site, whichever is less.Grants may2.8be made only for projects in existing buildings used as a2.9library, or to prepare another existing building for use as a2.10library. Renovation of an existing building may include an2.11addition to the building if the additional space is necessary to2.12provide accessibility or if relocating public spaces to the2.13ground level provides improved overall accessibility. Grants2.14must not be used to pay part of the cost of meeting2.15accessibility requirements in a new building.2.16 Sec. 4. [APPROPRIATION.] 2.17 $10,000,000 is appropriated from the bond proceeds fund to 2.18 the commissioner of education for library capital improvement 2.19 grants to renovate or expand an existing building for use as a 2.20 library or to construct a new library building under Minnesota 2.21 statutes, section 134.45, subject to the requirements of 2.22 Minnesota Statutes, section 16A.695. 2.23 Sec. 5. [BOND SALE.] 2.24 To provide the money appropriated in section 2 from the 2.25 bond proceeds fund, the commissioner of finance, on request of 2.26 the governor, shall sell and issue bonds of the state in an 2.27 amount up to $10,000,000 in the manner, on the terms, and with 2.28 the effect prescribed by Minnesota Statutes, sections 16A.631 to 2.29 16A.675, and by the Minnesota Constitution, article XI, sections 2.30 4 to 7. 2.31 Sec. 6. [EFFECTIVE DATE.] 2.32 Sections 1 to 5 are effective the day following final 2.33 enactment.
