A bill for an act
relating to crimes; making it a gross misdemeanor
crime for a railroad or a person employed by a
railroad to obstruct the treatment of a railroad
worker injured on the job or to discipline or threaten
to discipline the railroad employee injured on the job
for requesting treatment or first aid; imposing
criminal penalties; proposing coding for new law in
Minnesota Statutes, chapter 609.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) It shall be unlawful for a railroad or person employed
by a railroad negligently or intentionally to:

(1) deny, unreasonably delay, or interfere with medical
treatment or first aid treatment to an employee of a railroad
who has been injured during employment; or

(2) discipline or threaten to discipline an employee of a
railroad who has been injured during employment for requesting
medical treatment or first aid treatment.

(b) A person convicted of a violation of paragraph (a),
clause (1) or (2), is guilty of a gross misdemeanor and may be
sentenced to imprisonment for not more than one year or to
payment of a fine of not more than $3,000, or both.

Section 1 is effective August 1, 2005, and applies to
crimes committed on or after that date.
