  1.1                          A bill for an act 
  1.2             relating to occupations; requiring plumbers to be 
  1.3             licensed in all cities regardless of size; amending 
  1.4             Minnesota Statutes 1996, section 326.40, subdivision 
  1.5             1; repealing Minnesota Statutes 1996, section 326.45. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 326.40, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [PLUMBERS MUST BE LICENSED IN CERTAIN 
  1.10  CITIES; MASTER AND JOURNEYMAN PLUMBERS; PLUMBING ON ONE'S OWN 
  1.11  PREMISES; RULES FOR EXAMINATION.] In any home rule charter or 
  1.12  statutory city now or hereafter having 5,000 or more population, 
  1.13  according to the last federal census, and having that has a 
  1.14  system of waterworks or sewerage, no person, firm, or 
  1.15  corporation shall engage in or work at the business of a master 
  1.16  plumber or journeyman plumber unless licensed to do so by the 
  1.17  state commissioner of health.  A master plumber may also work as 
  1.18  a journeyman plumber.  Anyone not so licensed may do plumbing 
  1.19  work which complies with the provisions of the minimum standard 
  1.20  prescribed by the state commissioner of health on premises or 
  1.21  that part of premises owned and actually occupied by the worker 
  1.22  as a residence, unless otherwise forbidden to do so by a local 
  1.23  ordinance. 
  1.24     In any such city no person, firm, or corporation shall 
  1.25  engage in the business of installing plumbing nor install 
  2.1   plumbing in connection with the dealing in and selling of 
  2.2   plumbing material and supplies unless at all times a licensed 
  2.3   master plumber, who shall be responsible for proper 
  2.4   installation, is in charge of the plumbing work of the person, 
  2.5   firm, or corporation. 
  2.6      The department of health shall prescribe rules, not 
  2.7   inconsistent herewith, for the examination and licensing of 
  2.8   plumbers. 
  2.9      Sec. 2.  [CONTINUING EDUCATION LEGISLATION.] 
  2.10     The department of health shall prepare legislation that 
  2.11  addresses any necessary additional educational requirements for 
  2.12  plumbers affected by sections 1 and 4 to be presented to the 
  2.13  legislature by February 1, 1998. 
  2.14     Sec. 3.  [TRANSITION.] 
  2.15     An individual holding a restricted plumber's license or a 
  2.16  restricted plumbing contractor's license on July 1, 2000, 
  2.17  automatically qualifies for an unrestricted license at the same 
  2.18  level. 
  2.19     Sec. 4.  [REVISOR'S INSTRUCTION.] 
  2.20     The revisor shall change "326.45" to "326.44" in Minnesota 
  2.21  Statutes, sections 144.99, 326.37, 326.44, 326.45, 326.61, and 
  2.22  326.65. 
  2.23     Sec. 5.  [REPEALER.] 
  2.24     Minnesota Statutes 1996, section 326.45, is repealed. 
  2.25     Sec. 6.  [EFFECTIVE DATE.] 
  2.26     Sections 1, 3, 4, and 5 are effective July 1, 2000.
