  1.1                          A bill for an act
  1.2             relating to gambling; prohibiting location of a 
  1.3             state-operated or state-licensed gambling facility in 
  1.4             a city unless the voters of the city have approved the 
  1.5             facility in a referendum; providing for payment of 
  1.6             referendum costs; appropriating money. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [CASINO LOCATION; REFERENDUM.] 
  1.9      Subdivision 1.  [DEFINITION.] For purposes of this section, 
  1.10  "gambling facility" means a facility operated or licensed by the 
  1.11  state at which games commonly considered to be casino games are 
  1.12  conducted.  Gambling facility does not include (1) a racetrack 
  1.13  licensed under Minnesota Statutes, chapter 240, or (2) a 
  1.14  facility at which the only gambling conducted is lawful gambling 
  1.15  licensed under Minnesota Statutes, chapter 349. 
  1.16     Subd. 2.  [REFERENDUM.] No gambling facility may be located 
  1.17  within a home rule charter or statutory city unless the voters 
  1.18  of the city have approved the facility's presence in the city at 
  1.19  a general election or a special election called for that purpose.
  1.20     Subd. 3.  [COSTS PAID BY STATE.] The city clerk of a city 
  1.21  conducting a referendum under subdivision 2 may submit to the 
  1.22  commissioner of finance an itemized statement of the city's 
  1.23  costs of holding a special election or of including the 
  1.24  referendum on the general election ballot in the city.  On 
  1.25  determining that the costs submitted are reasonable and reflect 
  1.26  the city's actual costs of holding the referendum, the 
  2.1   commissioner shall reimburse the city for the costs.  Amounts 
  2.2   necessary to pay reimbursements under this subdivision are 
  2.3   appropriated from the general fund to the commissioner of 
  2.4   finance. 
  2.5      [EFFECTIVE DATE.] This section is effective the day 
  2.6   following final enactment.
