  1.1                          A bill for an act 
  1.2             relating to state lands; modifying the authorization 
  1.3             to convey state land for an elementary school in Rice 
  1.4             county; amending Laws 1992, chapter 499, article 11, 
  1.5             section 9, as amended. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Laws 1992, chapter 499, article 11, section 9, 
  1.8   as amended by Laws 1994, chapter 647, article 5, section 17, is 
  1.9   amended to read: 
  1.10     Sec. 9.  [LAND TRANSFER.] 
  1.11     Subdivision 1.  [PERMITTED.] (a) Notwithstanding Minnesota 
  1.12  Statutes, chapters 94 and 103F or any other law to the contrary, 
  1.13  the state of Minnesota may convey the land described in 
  1.14  paragraph (b) to independent school district No. 656, Faribault. 
  1.15     (b) The land which may be conveyed under paragraph (a) is 
  1.16  legally described in general as follows:  
  1.17     All that part of the Southeast Quarter of the Southwest 
  1.18     Quarter (SE 1/4 of SW 1/4) and all that part of the 
  1.19     Southwest Quarter of the Southeast Quarter (SW 1/4 of SE 
  1.20     1/4), all in Section 29, Township 110 North, Range 20 West, 
  1.21     in the City of Faribault, Rice County, Minnesota, owned by 
  1.22     the state of Minnesota or any department or division 
  1.23     thereof. 
  1.24     or 
  1.25     All that part of the Northwest Quarter of the Southwest 
  2.1      Quarter (NW 1/4 of SW 1/4) of Section 28, and of the 
  2.2      Northeast Quarter of the Southeast Quarter (NE 1/4 of SE 
  2.3      1/4) of Section 29, all in Township 110 North, Range 20 
  2.4      West, Rice County, Minnesota, owned by the State of 
  2.5      Minnesota or any department or division thereof. 
  2.6      (c) A more precise legal description in substantial 
  2.7   conformance with the description in paragraph (b) must be 
  2.8   provided by the grantee in the instruments of 
  2.9   conveyance.  Because of the topography of the site, and the need 
  2.10  to relocate Parshall street, Faribault, to accommodate the 
  2.11  construction of a new elementary school, independent school 
  2.12  district No. 656, Faribault, may exchange two small parcels, 2.5 
  2.13  to 3.5 acres each, of the land described in paragraph (b) for 
  2.14  parcels of comparable value, contiguous to the land.  In 
  2.15  addition, independent school district No. 656, Faribault, is 
  2.16  purchasing a parcel of about 4.7 acres immediately south of the 
  2.17  land described in paragraph (b).  A portion of the land is to be 
  2.18  dedicated for the relocation of Parshall street. 
  2.19     (d) The state may convey the land described in paragraph 
  2.20  (b), without reverter, to independent school district No. 656, 
  2.21  Faribault, so that the land transfers may occur.  Once the 
  2.22  transfers have occurred and there is a unified parcel for the 
  2.23  new elementary school, independent school district No. 656, 
  2.24  Faribault, shall convey the entire parcel back to the state, 
  2.25  and, the state shall convey this unified parcel back to 
  2.26  independent school district No. 656, Faribault, with the right 
  2.27  of reverter to the state.  
  2.28     (e) Both the precise legal descriptions and the instruments 
  2.29  of conveyance must be approved as to form by the attorney 
  2.30  general.  
  2.31     Subd. 2.  [CONSIDERATION.] The consideration for the 
  2.32  conveyance permitted by subdivision 1 is the amount of $1.  
  2.33     Subd. 3.  [PURPOSE.] The land permitted to be conveyed 
  2.34  under subdivision 1 is to be used as part of a site for an 
  2.35  elementary school. 
  2.36     Subd. 4.  [TITLE REVERTS TO STATE.] If the lands described 
  3.1   in subdivision 1 are If the unified parcel in subdivision 1, 
  3.2   paragraph (d), conveyed by the state to independent school 
  3.3   district No. 656, Faribault, is not used for a public purpose, 
  3.4   or upon discontinuance of such use, the title for the property 
  3.5   shall revert to the state. 
  3.6      Sec. 2.  [EFFECTIVE DATE.] 
  3.7      Section 1 is effective the day following final enactment.
