  1.1                          A bill for an act 
  1.2             relating to gambling enforcement; requiring certain 
  1.3             notification prior to initiating video surveillance in 
  1.4             some cases; amending Minnesota Statutes 2002, section 
  1.5             299L.06. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 299L.06, is 
  1.8   amended to read: 
  1.9      299L.06 [JURISDICTION; INVESTIGATIONS.] 
  1.10     Subdivision 1.  [PRIMARY JURISDICTION.] In any 
  1.11  investigation or other enforcement activity where there is 
  1.12  probable cause to believe that a criminal violation relating to 
  1.13  gambling has occurred, except a violation relating only to 
  1.14  taxation, the division rather than any other state department, 
  1.15  agency, or office shall be the primary investigation entity 
  1.16  where enforcement rests. 
  1.17     Subd. 2.  [INVESTIGATIONS; VIDEO SURVEILLANCE; 
  1.18  NOTIFICATION.] Prior to initiating video surveillance in the 
  1.19  investigation of suspected gambling regulation violations, the 
  1.20  director or an authorized investigator must notify the owner or 
  1.21  top official of the establishment where the surveillance will 
  1.22  occur.  This subdivision applies even if permission to initiate 
  1.23  video surveillance is granted by another person with the legal 
  1.24  authority to do so.  Notifying the owner or top official is not 
  1.25  required if, in the judgment of the director, doing so would 
  2.1   hinder the investigation. 
  2.2      [EFFECTIVE DATE.] This section is effective August 1, 2003.
