A bill for an act
relating to nonprofit organizations; establishing a nonprofit capacity building
grant program; requiring the attorney general to post certain tax records filed by
charitable organizations; requiring a report; appropriating money; amending
Minnesota Statutes 2014, section 309.54, subdivision 1; proposing coding for
new law in Minnesota Statutes, chapter 116J.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin The commissioner shall develop and implement a
competitive grant program to provide assistance and training to nonprofit organizations,
including, but not limited to: governance board operating procedures; financial
management and reporting requirements; and executive management training. Grants
under this subdivision may also be used to conduct research and collect data regarding
the nonprofit sector in Minnesota.

new text begin By January 15 of each year, the commissioner must report to
the legislative committees with jurisdiction over economic development regarding the
following: methodologies and processes for soliciting and evaluating grant proposals
under this section; criteria and methodology for selecting grant recipients; and methods for
measuring outcomes and accomplishments of grant recipients. The commissioner must
solicit comments and feedback from interested parties regarding ongoing improvements
and enhancements to the competitive grant program. The commissioner shall also report on
the expenditures related to the administration and monitoring of grants under this section.

Sec. 2.

Minnesota Statutes 2014, section 309.54, subdivision 1, is amended to read:

new text begin (a) new text end Registration statements, annual reports, and other documents required to be
filed shall become public records in the Office of the Attorney General.

new text begin (b) The attorney general shall post the Internal Revenue Service Form 990, including
schedules and amendments that are required to be filed by a charitable organization under
section 309.53, subdivision 2, on the Web site containing the charities database for the
time period during which the information must be available for public inspection under
federal law.

new text begin $500,000 is appropriated to the commissioner of employment and economic
development from the general fund in fiscal year 2016 for nonprofit capacity building
grants under Minnesota Statutes, section 116J.664.
