  1.1                          A bill for an act
  1.2             relating to crime; providing criminal penalties for 
  1.3             adults who approach, contact, or speak to a minor who 
  1.4             is not related to the actor, with intent to commit 
  1.5             sexual conduct or a criminal or delinquent act; 
  1.6             amending Minnesota Statutes 1996, sections 609.352, 
  1.7             subdivisions 1 and 2; and 609.494, subdivision 1. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1996, section 609.352, 
  1.10  subdivision 1, is amended to read: 
  1.11     Subdivision 1.  [DEFINITIONS.] As used in this section: 
  1.12     (a) "child" means a person under the age of 15 years; 
  1.13     (b) "sexual conduct" means sexual contact of the 
  1.14  individual's primary genital area, sexual penetration as defined 
  1.15  in section 609.341, or sexual performance as defined in section 
  1.16  617.246; and 
  1.17     (c) (b) "solicit" means commanding, entreating, or 
  1.18  attempting to persuade a specific person. 
  1.19     Sec. 2.  Minnesota Statutes 1996, section 609.352, 
  1.20  subdivision 2, is amended to read: 
  1.21     Subd. 2.  [PROHIBITED ACT ACTS.] A person 18 years of age 
  1.22  or older who, with intent to engage in sexual conduct: 
  1.23     (1) solicits a child minor to engage in sexual conduct with 
  1.24  intent to engage in sexual conduct; or 
  1.25     (2) approaches, contacts, or speaks to a minor who is not 
  1.26  related to the actor, 
  2.1   is guilty of a felony and may be sentenced to imprisonment for 
  2.2   not more than three years, or to payment of a fine of not more 
  2.3   than $5,000, or both. 
  2.4      Sec. 3.  Minnesota Statutes 1996, section 609.494, 
  2.5   subdivision 1, is amended to read: 
  2.6      Subdivision 1.  [CRIME.] A person is guilty of a crime and 
  2.7   may be sentenced as provided in subdivision 2 if the person is 
  2.8   an adult and: 
  2.9      (1) solicits or conspires with a minor to commit a crime or 
  2.10  delinquent act; 
  2.11     (2) approaches, contacts, or speaks to a minor who is not 
  2.12  related to the actor, with intent to cause the minor to commit a 
  2.13  criminal or delinquent act; or 
  2.14     (3) is an accomplice to a minor in the commission of a 
  2.15  crime or delinquent act. 
  2.16     Sec. 4.  [EFFECTIVE DATE.] 
  2.17     Sections 1 to 3 are effective August 1, 1997, and apply to 
  2.18  crimes committed on or after that date.
