  1.1                          A bill for an act 
  1.2             relating to real property; clarifying ownership of 
  1.3             certain parcels of land in Chippewa county. 
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  [LAC QUI PARLE LAKE AND HIGHWAY 40.] 
  1.6      (a) Notwithstanding other law, the commissioner of natural 
  1.7   resources shall convey to Ms. Jane Randall of Milan, Minnesota, 
  1.8   the state's interest, if any, in the following described parcels 
  1.9   of real property: 
  1.10     (1) That part of Government Lot 3, Section 19, township 119 
  1.11  north, range 42 west, and Government Lot 3, section 24, township 
  1.12  119 north, range 43 west, all in Chippewa County, Minnesota, 
  1.13  lying below the 945 foot contour as established from U.S.C.E. 
  1.14  Bench mark No. 562, located near the west sixteenth line 
  1.15  approximately 370 feet north of the east and west quarter line 
  1.16  of section 34, township 120 north, range 43 west, Swift County, 
  1.17  Minnesota; brass plug elevation - 949.83; cap elevation - 
  1.18  953.69; containing 5.68 acres, more or less. 
  1.19     (2) That part of Government Lot 3 of Section 19, Township 
  1.20  119 north, Range 42 west, lying Northwesterly of the center line 
  1.21  of Trunk Highway No. 40 and which lies within a distance of 100 
  1.22  feet on each side of the following described line: 
  1.23     Beginning at a point on the northerly boundary of said 
  1.24  Section 19, distant 1,380.9 feet easterly of the northwest 
  2.1   corner thereof; thence run southwesterly at an angle of 88 
  2.2   degrees 58 minutes with said northerly boundary for a distance 
  2.3   of 2,396 feet; thence deflect to the right on a 5 degrees 00 
  2.4   minutes curve, delta angle 48 degrees 51 minutes, for a distance 
  2.5   of 977 feet; thence on tangent to said curve for a distance of 
  2.6   1,100 feet, and there terminating, except that portion which 
  2.7   lies within 60 feet of said line; all in Chippewa County, 
  2.8   Minnesota. 
  2.9      (b) The parcels described in paragraph (a) have been in the 
  2.10  Randall family for 60 years, have been used as a part of a free 
  2.11  public access boat launch site by the owners, who have paid 
  2.12  taxes on them through the family's entire period of ownership.  
  2.13  The state has made some claim to ownership based on a 
  2.14  condemnation award with a confusing reference to benchmarks. The 
  2.15  conveyances are necessary to clear title, to recognize the 
  2.16  equities in favor of Ms. Randall's interest, to clarify that 
  2.17  there is consistent width to the highway 40 right-of-way, and to 
  2.18  keep the free public access boat launch without public expense 
  2.19  for acquisition and upkeep.
