  1.1                          A bill for an act 
  1.2             relating to the military; authorizing the payment of 
  1.3             salary differential for reserve forces on active duty 
  1.4             in Haiti; proposing coding for new law in Minnesota 
  1.5             Statutes, chapter 43A. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [43A.183] [PAYMENT OF SALARY DIFFERENTIAL FOR 
  1.8   RESERVE FORCES ON ACTIVE DUTY.] 
  1.9      Each agency head shall pay to each eligible member of the 
  1.10  reserve components of the armed forces of the United States an 
  1.11  amount equal to the difference between the member's basic active 
  1.12  duty military salary and the salary the member would be paid as 
  1.13  an active state employee, including any adjustments the member 
  1.14  would have received if not on leave of absence.  This payment 
  1.15  may be made only to a person whose basic active duty military 
  1.16  salary is less than the salary the person would be paid as an 
  1.17  active state employee.  Payments must be made at the intervals 
  1.18  at which the member received pay as a state employee.  Back pay 
  1.19  authorized by this section may be paid in a lump sum.  Pay under 
  1.20  this section may not extend beyond four years from the date the 
  1.21  employee was called to active duty plus any additional time in 
  1.22  each case that the employee may be required to serve under law. 
  1.23     An eligible member of the reserve components of the armed 
  1.24  forces of the United States is a reservist or national guard 
  1.25  member who was an employee of the state of Minnesota at the time 
  2.1   the member was called to active duty and who was or is called to 
  2.2   active duty after August 1, 1994, for service in Haiti relating 
  2.3   to political unrest and a need to safeguard election processes. 
  2.4      For the purposes of this section, an employee of the state 
  2.5   is an employee of the executive, judicial, or legislative branch 
  2.6   of state government or an employee of the Minnesota state 
  2.7   retirement system, the public employee retirement association, 
  2.8   or the teachers retirement association. 
  2.9      The commissioner of employee relations and the commissioner 
  2.10  of finance shall adopt procedures required to implement this 
  2.11  section.  The procedures are exempt from chapter 14. 
  2.12     This section expires June 30, 2002.
