  1.1                          A bill for an act 
  1.2             relating to health care; requiring certification of a 
  1.3             facility to serve persons with Prader-Willi Syndrome. 
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  [FACILITY CERTIFICATION.] 
  1.6      The commissioner of human services shall certify a large 
  1.7   community-based facility currently licensed under Minnesota 
  1.8   Rules, parts 9525.0215 to 9525.0355, for more than 16 beds and 
  1.9   located in Northfield, to be eligible for medical assistance 
  1.10  funding for a 44-bed crisis and transitional facility for 
  1.11  persons with Prader-Willi Syndrome.  The commissioner may also 
  1.12  certify the facility to provide other services to persons with 
  1.13  mental retardation or related conditions.  The commissioner must 
  1.14  certify the facility within 90 days of the effective date of 
  1.15  this section.  The commissioner shall also work with the 
  1.16  facility and affected counties to relocate residents of the 
  1.17  facility who are not diagnosed with Prader-Willi Syndrome or in 
  1.18  need of other services provided in the facility to appropriate 
  1.19  alternative facilities within a reasonable amount of time, but 
  1.20  not to exceed four years from the date of certification.  In the 
  1.21  event that the facility closes and alternative services for the 
  1.22  residents are necessary, the commissioner may transfer on a 
  1.23  quarterly basis to the medical assistance account from each 
  1.24  affected county's community social service allocation, an amount 
  2.1   equal to the state share of medical assistance reimbursement for 
  2.2   the residential and day habilitation services funded by medical 
  2.3   assistance and provided to clients for whom the county is 
  2.4   financially responsible.
