  1.1                          A bill for an act 
  1.2             relating to highways; advancing construction projects 
  1.3             on I-494; authorizing design-build construction on 
  1.4             I-494; temporarily suspending construction of 
  1.5             I-35W/trunk highway No. 62 improvement project; 
  1.6             requiring redesign of construction projects; 
  1.7             redirecting available funds to I-494 project; 
  1.8             appropriating money; authorizing issuance of trunk 
  1.9             highway bonds. 
  1.10  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.11     Section 1.  [ADVANCEMENT OF I-494 TRANSPORTATION PROJECTS 
  1.12  IN CONSTRUCTION SCHEDULE.] 
  1.13     Subdivision 1. [DESCRIPTION OF PROJECT.] The commissioner 
  1.14  of transportation shall advance, to the maximum feasible extent, 
  1.15  the schedule for marked interstate highway I-494 construction of 
  1.16  interchanges, bridges, access modifications, and an additional 
  1.17  travel lane in each direction between marked interstate highway 
  1.18  I-394 and 34th Avenue. 
  1.19     Subd. 2.  [DESIGN-BUILD AUTHORIZATION.] The commissioner of 
  1.20  transportation may use, for the project described in subdivision 
  1.21  1, a design-build method of project development and 
  1.22  construction, in which a single contractor is responsible for 
  1.23  both the design and construction of the project and bids the 
  1.24  design and construction together.  Notwithstanding Minnesota 
  1.25  Statutes, section 16C.06, the commissioner may award a 
  1.26  design-build contract on the basis of requests for proposals or 
  1.27  request for qualifications without bids. 
  2.1      Sec. 2.  [TEMPORARY SUSPENSION OF I-35W/TRUNK HIGHWAY NO. 
  2.2   62 CLOSURE AND TRANSPORTATION CONSTRUCTION PROJECT.] 
  2.3      Subdivision 1.  [SUSPENSION OF WORK.] The commissioner of 
  2.4   transportation shall temporarily suspend work on the marked 
  2.5   interstate highway I-35W/trunk highway marked No. 62 closure and 
  2.6   improvement project, involving separation of the two roadways in 
  2.7   the commons area, replacement of ramps, construction of a 
  2.8   high-occupancy vehicle lane, and changes in access. 
  2.9      Subd. 2.  [REDESIGN OF PROJECT.] The commissioner shall 
  2.10  approve a design and construction staging plan for the marked 
  2.11  interstate highway I-35W/trunk highway marked No. 62 crosstown 
  2.12  commons and I-35W construction projects that will add capacity 
  2.13  in excess of the current design to the commons area and to 
  2.14  northbound I-35W and will minimize the length of highway closure 
  2.15  time. 
  2.16     Subd. 3.  [RESUMPTION OF PROJECT WORK.] The commissioner 
  2.17  shall resume work on the project described in subdivision 1 
  2.18  after the completion of the construction of a third lane in each 
  2.19  direction and replacement and redecking of bridges on marked 
  2.20  interstate highway I-494 from marked interstate highway I-394 to 
  2.21  marked trunk highway No. 100. 
  2.22     Sec. 3.  [REDIRECTION OF FUNDS.] 
  2.23     The commissioner of transportation shall redirect all funds 
  2.24  available from any source from the marked interstate highway 
  2.25  I-35W/trunk highway marked No. 62 improvement project to the 
  2.26  I-494 reconstruction projects described in section 1. 
  2.27     Sec. 4.  [APPROPRIATION.] 
  2.28     $....... is appropriated to the commissioner of 
  2.29  transportation from the bond proceeds account in the trunk 
  2.30  highway fund.  $....... of this appropriation is for the 
  2.31  purposes stated in sections 1 and 2, and $....... is for bond 
  2.32  sale expenses under Minnesota Statutes, section 16A.641, 
  2.33  subdivision 8. 
  2.34     Sec. 5.  [BOND SALE AUTHORIZATION.] 
  2.35     To provide the money appropriated in this act from the 
  2.36  trunk highway bond proceeds fund, the commissioner of finance 
  3.1   shall sell and issue bonds of the state in an amount up to 
  3.2   $....... in the manner, upon the terms, and with the effect 
  3.3   prescribed by Minnesota Statutes, sections 167.50 to 167.52, and 
  3.4   by the Minnesota Constitution, article XIV, section 11, at the 
  3.5   times and in the amounts requested by the commissioner of 
  3.6   transportation.  The proceeds of the bonds, except accrued 
  3.7   interest and any premium received on the sale of the bonds, must 
  3.8   be credited to a bond proceeds account in the trunk highway fund.
