  1.1                          A bill for an act 
  1.2             relating to civil actions; providing a limitation on 
  1.3             actions based on errors or omissions in housing 
  1.4             inspections; proposing coding for new law in Minnesota 
  1.5             Statutes, chapter 541. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [541.053] [LIMITATIONS OF ACTIONS FOR DAMAGES 
  1.8   BASED ON ERRORS OR OMISSIONS IN HOUSING INSPECTION.] 
  1.9      Except as modified in a written contract or where fraud is 
  1.10  involved, no action or claim to recover damages for: 
  1.11     (1) an error or omission in a housing inspection of a 
  1.12  residential home including a building, at least part of which is 
  1.13  used for residential purposes; or 
  1.14     (2) contribution or indemnification for damages sustained 
  1.15  on account of an error or omission; 
  1.16  may be brought against a housing inspector performing the 
  1.17  inspection, more than two years after the date of the inspection 
  1.18  or, if an inspection report is prepared, no more than two years 
  1.19  after the date of the report. 
  1.20     For purposes of this section, "housing inspector" means a 
  1.21  person licensed under a municipal ordinance as a housing 
  1.22  evaluator or housing inspector to conduct private housing 
  1.23  inspections pursuant to the municipal ordinance or a person who 
  1.24  conducts private housing inspections, pursuant to a written 
  1.25  contract with the owner or perspective purchaser of a 
  2.1   residential home. 
  2.2      Sec. 2.  [EFFECTIVE DATE.] 
  2.3      Section 1 is effective on the day following final enactment 
  2.4   and applies to housing inspections performed on or after that 
  2.5   date.
