  1.1                          A bill for an act 
  1.2             relating to education; providing for courses for fees, 
  1.3             unlicensed teaching of students during teacher 
  1.4             preparation time, and a cash flow waiver for school 
  1.5             districts in statutory operating debt status; amending 
  1.6             Minnesota Statutes 1994, sections 120.73, by adding a 
  1.7             subdivision; and 124.195, by adding a subdivision; 
  1.8             proposing coding for new law in Minnesota Statutes, 
  1.9             chapter 125. 
  1.10  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.11     Section 1.  Minnesota Statutes 1994, section 120.73, is 
  1.12  amended by adding a subdivision to read: 
  1.13     Subd. 5.  [COURSE FEES.] Notwithstanding section 120.74, 
  1.14  subdivision 1, for any district exceeding its expenditure 
  1.15  limitations under section 121.917, as computed as of June 30 of 
  1.16  the prior school year, for the next school year a school board 
  1.17  may approve the charging of a fee for an elective secondary 
  1.18  course if there is an insufficient number of students to 
  1.19  financially justify the course and the course can only be 
  1.20  offered if a fee is charged.  The course shall be approved for 
  1.21  graduation credits if it would be offered for credit if a fee 
  1.22  was not charged. 
  1.23     Sec. 2.  [125.041] [CLASSROOM TEACHER DURING TEACHER 
  1.24  PREPARATION TIME.] 
  1.25     Notwithstanding section 125.04 or 125.05, or any other law 
  1.26  to the contrary, for any district exceeding its expenditure 
  1.27  limitations under section 121.917, as computed as of June 30 of 
  2.1   the prior school year, for the next school year a teacher 
  2.2   providing instruction to elementary school pupils while the 
  2.3   regular classroom teacher is using preparation time under 
  2.4   section 125.706, is not required to hold a teacher's license 
  2.5   under section 125.05, subdivision 1a. 
  2.6      Sec. 3.  Minnesota Statutes 1994, section 124.195, is 
  2.7   amended by adding a subdivision to read: 
  2.8      Subd. 3c.  [CASH FLOW WAIVER.] For any district exceeding 
  2.9   its expenditure limitations under section 121.917, the 
  2.10  commissioner of education and a school board shall negotiate an 
  2.11  accelerated payment schedule under subdivision 3 so as to 
  2.12  minimize the district's short-term borrowing needs.
