  1.1                          A bill for an act 
  1.2             relating to education; creating a year-round school 
  1.3             pilot program; appropriating money; amending Minnesota 
  1.4             Statutes 1994, sections 124.223, subdivision 8; and 
  1.5             124.243, subdivision 2. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 124.223, 
  1.8   subdivision 8, is amended to read: 
  1.9      Subd. 8.  [SUMMER INSTRUCTIONAL PROGRAMS.] State 
  1.10  transportation aid is authorized for services described in 
  1.11  subdivisions 1 to 7, 9, and 10 when provided for pupils with a 
  1.12  disability in conjunction with a summer program that meets the 
  1.13  requirements of section 124A.27, subdivision 9.  State 
  1.14  transportation aid is authorized for services described in 
  1.15  subdivision 1 when provided during the summer in conjunction 
  1.16  with a learning year program established under section 
  1.17  121.585 or a flexible learning year program established under 
  1.18  sections 120.59 to 120.67. 
  1.19     Sec. 2.  Minnesota Statutes 1994, section 124.243, 
  1.20  subdivision 2, is amended to read: 
  1.21     Subd. 2.  [CAPITAL EXPENDITURE FACILITIES REVENUE.] (a) For 
  1.22  fiscal years 1994 and 1995, capital expenditure facilities 
  1.23  revenue for a district equals $128 times its actual pupil units 
  1.24  for the school year. 
  1.25     (b) For fiscal years 1996 and later, capital expenditure 
  2.1   facilities revenue for a district equals $100 times the 
  2.2   district's maintenance cost index times its actual pupil units 
  2.3   for the school year. 
  2.4      (c) A district's capital expenditure facilities revenue for 
  2.5   a school year shall be reduced if the unreserved balance in the 
  2.6   capital expenditure facilities account on June 30 of the prior 
  2.7   school year exceeds $675 times the fund balance pupil units in 
  2.8   the prior year as defined in section 124A.26, subdivision 1.  If 
  2.9   a district's capital expenditure facilities revenue is reduced, 
  2.10  the reduction equals the lesser of (1) the amount that the 
  2.11  unreserved balance in the capital expenditure facilities account 
  2.12  on June 30 of the prior year exceeds $675 times the fund balance 
  2.13  pupil units in the prior year, or (2) the capital expenditure 
  2.14  facilities revenue for that year. 
  2.15     (d) For 1996 and later fiscal years, the previous formula 
  2.16  revenue equals the amount of revenue computed for the district 
  2.17  according to section 124.243 for fiscal year 1995. 
  2.18     (e) Notwithstanding paragraph (b), for fiscal year 1996, 
  2.19  the revenue for each district equals 25 percent of the amount 
  2.20  determined in paragraph (b) plus 75 percent of the previous 
  2.21  formula revenue. 
  2.22     (f) Notwithstanding paragraph (b), for fiscal year 1997, 
  2.23  the revenue for each district equals 50 percent of the amount 
  2.24  determined in paragraph (b) plus 50 percent of the previous 
  2.25  formula revenue. 
  2.26     (g) Notwithstanding paragraph (b), for fiscal year 1998, 
  2.27  the revenue for each district equals 75 percent of the amount 
  2.28  determined in paragraph (b) plus 25 percent of the previous 
  2.29  formula revenue. 
  2.30     (h) The revenue in paragraph (b) for a district that 
  2.31  operates a program under section 121.585 or sections 120.59 to 
  2.32  120.67, is increased by an amount equal to $15 $25 times the 
  2.33  number of a district's actual pupil units at the site where the 
  2.34  program is implemented. 
  2.35     Sec. 3.  [YEAR-ROUND SCHOOL PILOT PROGRAM GRANTS.] 
  2.36     A school district that intends to establish and operate a 
  3.1   year-round school program is eligible for a one-time planning 
  3.2   grant of up to $100,000.  For purposes of this section and 
  3.3   section 4, a year-round school program is a flexible learning 
  3.4   year program under Minnesota Statutes, sections 120.59 to 
  3.5   120.67.  To be eligible, the district must apply to the 
  3.6   commissioner of education in the form and manner prescribed by 
  3.7   the commissioner.  In developing a year-round school plan, a 
  3.8   district must consider ways in which instructional methods and 
  3.9   learner outcomes will be improved, facilities and other 
  3.10  resources will be used more efficiently, and parent and 
  3.11  community involvement will be increased. 
  3.12     Sec. 4.  [YEAR-ROUND SCHOOL FACILITY GRANTS.] 
  3.13     A school district that implements a year-round school 
  3.14  program, and received a planning grant under section 3, is 
  3.15  eligible for a facility grant of up to $100,000 per building 
  3.16  operating a year-round school program.  To be eligible for a 
  3.17  grant, a district must apply to the commissioner of education.  
  3.18  The proceeds of the grant may be used to install or improve 
  3.19  heating, ventilation, and air conditioning systems in existing 
  3.20  buildings to accommodate year-round use of the buildings.  Grant 
  3.21  proceeds may also be used for deferred maintenance approved by 
  3.22  the commissioner. 
  3.23     Sec. 5.  [APPROPRIATIONS.] 
  3.24     Subdivision 1.  [DEPARTMENT OF EDUCATION.] The sums 
  3.25  indicated in this section are appropriated from the general fund 
  3.26  to the department of education in the fiscal year designated. 
  3.27     Subd. 2.  [YEAR-ROUND SCHOOL PILOT PROGRAM GRANTS.] For 
  3.28  year-round school pilot program grants under section 3:

  3.33     The amounts appropriated under this section do not cancel 
  3.34  but are available until June 30, 1997.
