  1.1                          A bill for an act 
  1.2             relating to retirement; Plymouth volunteer 
  1.3             firefighter's relief association; making various 
  1.4             ancillary benefits subject to general law; amending 
  1.5             Laws 1978, chapter 685, sections 1, as amended, 2, 3, 
  1.6             6; repealing Laws 1978, chapter 685, section 5. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Laws 1978, chapter 685, section 1, as amended 
  1.9   by Laws 1979, chapter 201, section 41, is amended to read: 
  1.10     Section 1.  [PLYMOUTH VOLUNTEER FIREFIGHTERS' RELIEF 
  1.11  ASSOCIATION.] 
  1.12     The bylaws of the Plymouth firefighter's relief association 
  1.13  may be amended to provide for payment of a disability pension in 
  1.14  an amount equal to $8.50 per month per year of service, to a 
  1.15  maximum of $255 per month consistent with the ancillary benefit 
  1.16  requirements specified in Minnesota Statutes, section 424A.02, 
  1.17  subdivision 9, to a firefighter qualified pursuant to determined 
  1.18  to be disabled, as defined in the bylaws of the association and 
  1.19  under procedures specified in those bylaws.  No member shall be 
  1.20  entitled to draw both a disability pension and a service pension.
  1.21     Sec. 2.  Laws 1978, chapter 685, section 2, is amended to 
  1.22  read: 
  1.23     Sec. 2.  The Plymouth firefighter's relief association may 
  1.24  provide for a benefit to the surviving spouse of a volunteer 
  1.25  firefighter who died, providing that the surviving spouse 
  1.26  qualifies under the terms of the bylaws, such benefit to be paid 
  2.1   as the bylaws of the association may provide, except that the 
  2.2   bylaws may not provide for a spouse's benefit of more than 
  2.3   $127.50 per month, and provided the benefit shall cease as of 
  2.4   the date of the spouse's remarriage and the benefit is 
  2.5   consistent with ancillary benefit requirements specified in 
  2.6   Minnesota Statutes, section 424A.02, subdivision 9. 
  2.7      Sec. 3.  Laws 1978, chapter 685, section 3, is amended to 
  2.8   read: 
  2.9      Sec. 3.  The Plymouth firefighter's relief association may 
  2.10  pay a pension for the children of deceased members, as the 
  2.11  association's bylaws may provide, consistent with ancillary 
  2.12  benefit requirements specified in Minnesota Statutes, section 
  2.13  424A.02, subdivision 9. 
  2.14     Sec. 4.  Laws 1978, chapter 685, section 6, is amended to 
  2.15  read: 
  2.16     Sec. 6.  (a) The bylaws of the Plymouth firefighter's 
  2.17  relief association may further provide that when any active or 
  2.18  deferred member of the association or any pensioner who is a 
  2.19  former member disabilitant or service pension recipient dies, 
  2.20  there may be paid a death or funeral benefit to defray or assist 
  2.21  the family of the deceased with funeral expenses. 
  2.22     (b) A benefit paid under this section due to the death of 
  2.23  an active or deferred member must conform to Minnesota Statutes, 
  2.24  section 424A.02, subdivision 9. 
  2.25     (c) A death or funeral benefit may be paid under this 
  2.26  section to the family of a deceased disabilitant or service 
  2.27  pensioner notwithstanding Minnesota Statutes, section 424A.02, 
  2.28  subdivision 9, providing that liabilities relating to this 
  2.29  benefit are recognized in determinations of actuarial condition 
  2.30  and funding costs, as determined under section 69.772 or 69.773, 
  2.31  whichever is applicable.  Notwithstanding any law to the 
  2.32  contrary, the association is authorized to use a load factor or 
  2.33  factors to recognize liabilities relating to funeral or death 
  2.34  benefits paid to the family of a deceased disabilitant or 
  2.35  service pensioner.  Benefits are not payable under this 
  2.36  paragraph if the city council does not approve the load factor 
  3.1   or factors used in determinations of actuarial conditions and 
  3.2   funding costs. 
  3.3      Sec. 5.  [REPEALER.] 
  3.4      Laws 1978, chapter 685, section 5, is repealed.  
  3.5      Sec. 6.  [EFFECTIVE DATE.] 
  3.6      (a) Sections 1 to 5 are effective on the day after the date 
  3.7   on which the Plymouth city council and the chief clerical 
  3.8   officer of the city of Plymouth complete in a timely manner 
  3.9   their compliance with Minnesota Statutes, section 645.021, 
  3.10  subdivisions 2 and 3. 
  3.11     (b) Sections 1 to 5 should not be interpreted as reducing 
  3.12  or otherwise diminishing benefits provided by the Plymouth 
  3.13  firefighter's relief association plan.
