  1.1                          A bill for an act 
  1.2             relating to agriculture; regulating pesticide 
  1.3             application in certain schools; amending Minnesota 
  1.4             Statutes 2000, section 18B.01, by adding a 
  1.5             subdivision; proposing coding for new law in Minnesota 
  1.6             Statutes, chapter 18B. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 18B.01, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 26a.  [SCHOOL PEST MANAGEMENT COORDINATOR.] "School 
  1.11  pest management coordinator" means a person employed by a school 
  1.12  district, private other than home-schooled, or parochial school 
  1.13  who is responsible for the school's pest management plans and 
  1.14  activities including training, coordination, communication, and 
  1.15  implementation of a school's integrated pest management plan, if 
  1.16  one is adopted under section 121A.30, subdivision 8, including 
  1.17  the application of pesticides to the inside or outdoor property 
  1.18  of the school. 
  1.19     Sec. 2.  [18B.095] [PESTICIDE APPLICATION IN SCHOOLS.] 
  1.20     Subdivision 1.  [AUTHORIZED APPLICATORS.] Application of a 
  1.21  pesticide to the inside or outdoor property of a school 
  1.22  district, private other than home-schooled, or parochial school 
  1.23  must be performed by: 
  1.24     (1) a structural pest control applicator; 
  1.25     (2) a commercial or noncommercial pesticide applicator with 
  1.26  appropriate use category certification; or 
  2.1      (3) a registered school pest management coordinator or a 
  2.2   school employee under the direction of a registered school pest 
  2.3   management coordinator. 
  2.4      Subd. 2.  [EXEMPTION.] Pesticides determined by the 
  2.5   commissioner to be sanitizers or disinfectants are exempt from 
  2.6   subdivision 1. 
  2.7      Subd. 3.  [REGISTRY AND INFORMATION.] The commissioner, in 
  2.8   consultation with the departments of health; administration; and 
  2.9   children, families, and learning; the University of Minnesota 
  2.10  Extension Service; the Minnesota School Boards Association; and 
  2.11  other persons as necessary and appropriate, must: 
  2.12     (1) establish and maintain a registry of school pest 
  2.13  management coordinators; and 
  2.14     (2) provide information on a regular and periodic basis to 
  2.15  registered school pest management coordinators on integrated 
  2.16  pest management techniques and programs, including model school 
  2.17  policies; proper pesticide use, storage, handling, and disposal; 
  2.18  and other relevant pesticide and pest management information. 
  2.19     Sec. 3.  [EFFECTIVE DATE.] 
  2.20     Section 2 is effective August 1, 2002.
