  1.1                          A bill for an act
  1.2             relating to automobile insurance; basic economic loss 
  1.3             benefits; providing compensation for in-home nursing 
  1.4             care; amending Minnesota Statutes 1994, section 
  1.5             65B.44, subdivision 2. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 65B.44, 
  1.8   subdivision 2, is amended to read: 
  1.9      Subd. 2.  [MEDICAL EXPENSE BENEFITS.] Medical expense 
  1.10  benefits shall reimburse all reasonable expenses for necessary 
  1.11  medical, surgical, X-ray, optical, dental, chiropractic, and 
  1.12  rehabilitative services, including prosthetic devices, 
  1.13  prescription drugs, necessary ambulance and all other reasonable 
  1.14  transportation expenses incurred in traveling to receive covered 
  1.15  medical benefits, hospital, extended care and nursing services.  
  1.16  Hospital room and board benefits may be limited, except for 
  1.17  intensive care facilities, to the regular daily semiprivate room 
  1.18  rates customarily charged by the institution in which the 
  1.19  recipient of benefits is confined.  Medical expense benefits 
  1.20  shall compensate the reasonable value of in-home nursing care 
  1.21  provided for an injured person at no expense to the injured 
  1.22  person.  Such benefits shall also include necessary remedial 
  1.23  treatment and services recognized and permitted under the laws 
  1.24  of this state for an injured person who relies upon spiritual 
  1.25  means through prayer alone for healing in accordance with that 
  2.1   person's religious beliefs.  Medical expense loss includes 
  2.2   medical expenses accrued prior to the death of a person 
  2.3   notwithstanding the fact that benefits are paid or payable to 
  2.4   the decedent's survivors.  Medical expense benefits for 
  2.5   rehabilitative services shall be subject to the provisions of 
  2.6   section 65B.45.
