1.1 A bill for an act 1.2 relating to crime; adding an exception to the crime of 1.3 female genital mutilation for certified nurse 1.4 midwives; amending Minnesota Statutes 1996, section 1.5 609.2245, subdivision 2. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 1996, section 609.2245, 1.8 subdivision 2, is amended to read: 1.9 Subd. 2. [PERMITTED ACTIVITIES.] A surgical procedure is 1.10 not a violation of subdivision 1 if the procedure: 1.11 (1) is necessary to the health of the person on whom it is 1.12 performed and is performed by: (i) a physician licensed under 1.13 chapter 147or; (ii) a physician in training under the 1.14 supervision of a licensed physician; or (iii) a certified nurse 1.15 midwife; or 1.16 (2) is performed on a person who is in labor or who has 1.17 just given birth and is performed for medical purposes connected 1.18 with that labor or birth: (i) by a physician licensed under 1.19 chapter 147or; (ii) a physician in training under the 1.20 supervision of a licensed physician; or (iii) a certified nurse 1.21 midwife. 1.22 Sec. 2. [EFFECTIVE DATE.] 1.23 Section 1 is effective on the day following final enactment.
